Article 1, paragraph 4, stipulates that " special measures " adopted in order to secure adequate advancement to certain racial or ethnic groups or individuals and the equal enjoyment of their human rights shall not be deemed racial discrimination, provided that such measures do not lead to the maintenance of separate rights for different racial groups and shall not be continued after the objectives for which they were taken have been achieved.

27. The second limitation on special measures is that " they shall not be continued after the objectives for which they have been taken have been achieved " . This limitation on the operation of special measures is essentially functional and goal-related: the measures should cease to be applied when the objectives for which they were employed -- the equality goals -- have been sustainably achieved.
27- أما التقييد الثاني للتدابير الخاصة فهو " شرط عدم استمرارها بعد بلوغ الأهداف التي اتخذت من أجلها " ، وهذا التقييد المفروض على تطبيق التدابير إنما هو قيد يؤدي وظيفة أساسية وذو صلة ببلوغ أهداف معينة على النحو التالي: ينبغي التخلّي عن تطبيق التدابير عند تحقيق استدامة الأهداف التي اتخذت من أجلها - أهداف المساواة(ح).

27. The second limitation on special measures is that " they shall not be continued after the objectives for which they have been taken have been achieved " . This limitation on the operation of special measures is essentially functional and goal-related: the measures should cease to be applied when the objectives for which they were employed - the equality goals - have been sustainably achieved.
27- أما التقييد الثاني للتدابير الخاصة فهو " شرط عدم استمرارها بعد بلوغ الأهداف التي اتخذت من أجلها " ، وهذا التقييد المفروض على تطبيق التدابير إنما هو قيد يؤدي وظيفة أساسية وذو صلة ببلوغ أهداف معينة على النحو التالي: ينبغي التخلّي عن تطبيق التدابير عند تحقيق استدامة الأهداف التي اتخذت من أجلها - أهداف المساواة().

The Committee further recommends that the State party guarantee that the special measures adopted to ensure the adequate development and protection of certain ethnic groups and their members in no case lead to the maintenance of unequal or separate rights for different ethnic groups after the objectives for which they were taken have been achieved (article 1, paragraph 4, and article 2, paragraph 2, of the Convention).
كما توصي اللجنة الدولة الطرف بأن تضمن ألا تؤدي التدابير الخاصة التي تتخذها لتأمين ما يكفي من التقدم والحماية لبعض الجماعات العرقية ولأفرادها، بأي حال من الأحوال، إلى الإبقاء على حقوق غير متساوية أو منفصلة لمختلف الجماعات العرقية بعد بلوغ الأهداف التي اتخذت من أجلها (الفقرة 4 من المادة 1 والفقرة 2 من المادة 2 من الاتفاقية).

The granting of affirmative action measures may not as a consequence lead to the maintenance of unequal or separate standards and they shall be discontinued after the objectives for which they have been taken have been achieved.
