The Working Group considered a note by the Secretariat entitled " Draft Technical Legislative Guide on the Implementation of a Security Rights Registry " (A/CN.9/WG.VI/WP.50 and Add.1-2).

16. In order to address the above-mentioned problems, security interests registries may need to be established or reorganized in accordance with the recommendations of the Guide and the draft Technical Legislative Guide on the Implementation of a Security Rights Registry.

The Working Group had before it the following documents: A/CN.9/WG.VI/WP.51 (Annotated Provisional Agenda), A/CN.9/WG.VI/WP.52 and Add.1-6 (Draft Technical Legislative Guide on the Implementation of a Security Rights Registry).

Adoption of the report of the Commission on this agenda item and of the Technical Legislative Guide on the Implementation of a Security Rights Registry may be expected to take place on Wednesday, 17 July 2013.

15. In the absence of an effective and efficient security interests registry, such as the one recommended in the Guide and in the draft Technical Legislative Guide on the Implementation of a Security Rights Registry, MFIs develop mechanisms that may or may not be legal or fair and probably do not protect sufficiently their security interests.
15- وفي غياب سجل فعَّال وكفؤٍ للمصالح الضمانية، مثل السجل الموصى به في الدليل التشريعي وفي مشروع الدليل التشريعي التقني لتنفيذ سجل للحقوق الضمانية، تستحدث مؤسسات التمويل البالغ الصغر آليات قد تكون، أو قد لا تكون، مشروعة أو منصفة، وربما لا توفر حماية كافية لمصالحها الضمانية.

After discussion, the Working Group tentatively agreed that the draft Registry Guide should be presented in the form of a separate, stand-alone, comprehensive text that would be consistent with the Guide, refer selectively to the Guide and be tentatively entitled " Technical Legislative Guide on the Implementation of a Security Rights Registry " .
30- وبعد المناقشة، اتفق الفريق العامل بصورة مؤقتة على أن يُقدم مشروع دليل السجل في شكل نص شامل وقائم بذاته ومستقل متفق مع الدليل التشريعي وعلى أن ترد فيه إشارات مختارة إلى الدليل التشريعي وأن يعنون مؤقتا باسم " الدليل التشريعي التقني لتنفيذ سجل الحقوق الضمانية " .

As to the presentation of the text, it was agreed that the draft Registry Guide should be presented as a separate, stand-alone, comprehensive text that would be consistent with the Secured Transactions Guide, and be tentatively entitled " Technical Legislative Guide on the Implementation of a Security Rights Registry " (A/CN.9/740, para. 30).
أمّا فيما يتعلق بهيئة عرض النص، فقد اتُّفق على أن يُعرَض مشروع دليل السجل في هيئة نص شامل وقائم بذاته ومستقل وأن يكون متّسقاً مع دليل المعاملات المضمونة، وأن يُعنوَن مؤقتاً " الدليل التشريعي التقني لتنفيذ سجل الحقوق الضمانية " (A/CN.9/740، الفقرة 30).

The Working Group first considered a note by the Secretariat entitled " Draft Technical Legislative Guide on the Implementation of a Security Rights Registry " (A/CN.9/WG.VI/WP.54 and Add.1-6), adopted the draft Registry Guide and referred it to the Commission for adoption at its forty-sixth session, which was scheduled to take place in Vienna from 8 to 26 July 2013.
