10. For these allegedly treasonable activities, Tek Nath Rizal and others were extradited from Nepal in November 1989.

11. The Government's position was that the acts attributed to Tek Nath Rizal constituted serious offences under the Bhutanese Law of Treason.
١١ - وكان موقف الحكومة أن اﻷفعال المنسوبة إلى تك نات ريزال تشكل جرائم فادحة بموجب قانون الخيانة البوتاني.

A perusal of the judgement of the High Court, a copy of which was forwarded to the Working Group, shows that Tek Nath Rizal was tried for the following nine charges:

" 2. Tek Nath Rizal sought the help of political parties in Nepal and Nepalese political leaders in the Duars to overthrow the legitimate and established Government in Bhutan, thus violating article 6 of the National Security Act, 1992.
" ٢ - سعى تك نات ريزال إلى الحصول على مساعدة اﻷحزاب السياسية في نيبال والقادة السياسيين النيباليين في دوارس لقلب الحكومة الشرعية في بوتان، مخالفا بذلك المادة ٦ من قانون اﻷمن الوطني العام ٢٩٩١.

" 4. Tek Nath Rizal attempted to create misunderstandings between friendly donor countries and the Royal Government of Bhutan by accusing the Royal Government of misusing foreign assistance, thus violating articles 8 and 9 of the National Security Act, 1992.
" ٤ - حاول تك نات ريزال خلق سوء التفاهم بين البلدان الصديقة المتبرعة وحكومة بوتان الملكية إذ اتهم هذه اﻷخيرة بسوء استعمال المساعدة الخارجية، مخالفا بذلك المادتين ٨ و٩ من قانون اﻷمن الوطني لعام ٢٩٩١.

14. The High Court held Tek Nath Rizal guilty of charges 2, 3, 5 and 7.
٤١ - واعتبرت المحكمة العليا تك نات ريزال مذنبا بالتهم ٢ و٣ و٥ و٧.

15. The following sentence was imposed in respect of each of the charges for which Tek Nath Rizal was convicted:

18. The Working Group believes that it cannot question the findings of the High Court in respect of the activities of Tek Nath Rizal which have been found to be proved.

It is also in evidence that Tek Nath Rizal organized meetings at Kakarbitta, Nepal and conspired with others to achieve his ends by violent and non-violent means for which purpose he authorized the collection of funds through threats or use of force.

6. In its reply dated 11 December 1991, the Government of Bhutan, although it did not deny the allegations, detailed the activities of Tek Nath Rizal which, according to the Government, were directed at inciting the people against the Government through a disinformation campaign and were further directed at damaging Bhutan's relations with a friendly neighbour, India.
٦ - وفي ردها المؤرخ في ١١ كانون اﻷول/ديسمبر ١٩٩١، أعطت حكومة بوتان، على الرغم من أنها لم تنف الادعاءات، تفاصيل عن أنشطة تك نات ريزال التي كانت موجهة، حسب قول الحكومة، إلى تحريض الشعب ضد الحكومة عبر حملة تشويه الحقائق، فضلا عن إلحاق الضرر بعلاقات بوتان مع بلد مجاور صديق هو الهند.

9. The Government further stated that while it was fortunate that the machinations of Tek Nath Rizal and others had not harmed Bhutan's traditionally good relations with India, they had nevertheless destabilized the Kingdom.
٩ - وأفادت الحكومة كذلك أن مؤامرات تك نات ريزال وغيره لم تضر، لحسن الحظ، بالعلاقات الطيبة لبوتان مع الهند، إلا أنها أضرت باستقرار المملكة.

According to the Government, Tek Nath Rizal had not been tried in a court of law for the simple reason that offences committed by him might have attracted capital punishment, which is mandatory for all treasonable offences, and that it would be extremely difficult to pardon him once the judicial processes were carried out and he was convicted.
وأفادت الحكومة أن تك نات ريزال لم يحاكم أمام محكمة لسبب بسيط هو أن الجرائم التي ارتكبها كانت قد تستوجب عقوبة الاعدام، التي هي إلزامية لجرائم الخيانة، وكان من الصعب جدا اصدار عفو عنه بعد اتمام الاجراءات القضائية وادانته.

12. Subsequently, on 26 June 1991, the Working Group sought a clarification from the Government of Bhutan, when the source referred to a statement attributed to the Government that Tek Nath Rizal was to be brought to trial in connection with his anti-national activities.
٢١ - وفي وقت لاحق، في ٦٢ حزيران/يونيه ١٩٩١، طلب الفريق العامل توضيحا من حكومة بوتان، عندما أشار المرجع إلى بيان منسوب إلى الحكومة يقول إن تك نات ريزال سيقدم إلى المحاكمة بالنسبة ﻷنشطته المضادة لﻷمة.
