Article 16 authorizes the procuring entity to require suppliers or contractors participating in the procurement proceedings to post a tender security so as to cover such potential losses and to discourage them from defaulting.
وتجيز المادة 16 للجهة المشترية أن تشترط على المورِّدين أو المقاولين المشاركين في إجراءات الاشتراء إيداع ضمانة عطاء لتغطية هذه الخسائر المحتملة وثنيهم عن التقصير.

A failure to obtain the approval within the time specified in the solicitation documents shall not extend the period of effectiveness of submissions specified in the solicitation documents or the period of effectiveness of the tender security required under article 16 of this Law.
ولا يؤدي عدم الحصول على الموافقة في غضون الفترة المحددة في وثائق الالتماس إلى تمديد مدة سريان مفعول العروض المقدَّمة المحددة في تلك الوثائق أو مدة سريان مفعول ضمانة العطاء المطلوبة بمقتضى المادة 16 من هذا القانون.

Amended definitions are: " procurement " , " procurement contract " , " procuring entity " , " supplier or contractor " and " tender security " :
13- والتعاريف المعدَّلة هي: " الاشتراء " ، و " عقد الاشتراء " ، و " الجهة المشترية " ، و " المورِّد أو المقاول " ، و " ضمانة العطاء " :

(e) The definition of " tender security " now reflects the fact that a tender security is provided to the procuring entity upon the requirement of the procuring entity.
(ﻫ) يبيّن تعريف " ضمانة العطاء " الآن كون ضمانة العطاء تُقدَّم إلى الجهة المشترية بناءً على طلبها.

3. Where applicable, the procurement regulations should refer to any law of the enacting State that prohibits the acceptance by the procuring entity of the tender security that is not issued by an issuer in the enacting State.
3- وينبغي، لدى الانطباق، أن تشير لوائح الاشتراء إلى أي قانون في الدولة المشترعة يحظر أن تقبل الجهة المشترية ضمانة العطاء التي لا تصدرها جهة إصدار في الدولة المشترعة.

It was further emphasized that one of the purposes of a tender security -- to relieve concerns of the procuring entity as regards the qualifications and capacities of suppliers or contractors in the procurement proceedings -- should not be overlooked in the commentary to article 17 of the 2011 Model Law.
كما شُدِّد على أنَّ أحد أغراض ضمانة العطاء - وهو تبديد مخاوف الجهة المشترية بشأن مؤهّلات وقدرات المورِّد أو المقاول المشارك في إجراءات الاشتراء - لا ينبغي إغفاله في التعليق على المادة 17 من القانون النموذجي لعام 2011.

With respect to subparagraph (e), concern was expressed about the use of the term " submission security " instead of " tender security " .

The proposal was made to include at the end of the last sentence the phrase " unless the extension has been granted to the procuring entity by suppliers or contractors that presented submissions and the entities that provided the tender security. "
65- اقتُرح أن تُدرَج في نهاية الجملة الأخيرة العبارة التالية: " ما لم يكن هذا التمديد قد مُنح للجهة المشترية من المورِّدين أو المقاولين الذين قدّموا العروض والجهات التي وفّرت ضمانة العطاء " .

(2) The procuring entity shall make no claim to the amount of the tender security, and shall promptly return, or procure the return of, the tender security document, after whichever of the following that occurs earliest:
)٢( لا يجوز للجهة المشترية أن تطالب بمبلغ ضمان العطاء وعليها أن تقوم على الفور بإعادة، أو تأمين إعادة، وثيقة ضمان العطاء بعد المواعيد التالية، أيها أسبق:

(b) the solicitation documents may stipulate that the issuer of the tender security and the confirmer, if any, of the tender security, as well as the form and terms of the tender security, must be acceptable to the procuring entity;

The Chair said that the report was supposed to reflect the actual conclusions reached, and the Commission had concluded that tender security " should not be the norm " .
62 - الرئيس: قال إن التقرير يُفترض أن يتضمن الاستنتاجات الفعلية التي جرى التوصل إليها، وإن اللجنة انتهت إلى أن ضمان العطاءات " لا ينبغي أن يكون هو القاعدة " .

A supplier or contractor whose tender security is not extended, or that has not provided a new tender security, is considered to have refused the request to extend the period of effectiveness of its tender.
ويُعتبر المورِّد أو المقاول الذي لم تُمدَّد ضمانة عطائه، أو الذي لم يقدّم ضمانة عطاء جديدة، أنه قد رَفَض طلب تمديد فترة نفاذ مفعول عطائه.

Project consortia not wishing to submit a final proposal should be allowed to withdraw from the selection proceedings without forfeiting any tender security that they may have been required to provide.
واتحادات المشروع غير الراغبة في تقديم مقترح نهائي ينبغي السماح لها بالانسحاب من اجراءات الاختيار دون مصادرة أي ضمانة من ضمانات العطاءات يكون قد طلب منها تقديمها .

(d) Prior to submitting a tender, a supplier or contractor may request the procuring entity to confirm the acceptability of a proposed issuer of a tender security, or of a proposed confirmer, if required; the procuring entity shall respond promptly to such a request;
)د( يجوز للمورد أو المقاول، قبل أن يقدم العطاء، أن يطلب من الجهة المشترية أن تصدق على مقبولية مصدر مقترح لضمان العطاء أو على مقبولية مصدق مقترح، إذا كان مطلوبا، وعلى الجهة المشترية أن ترد على هذا الطلب على الفور؛

8. In the light of the cost of providing a tender security, which will normally be reflected in the contract price, the use of alternatives to a tender security should be considered and encouraged where appropriate.
8- وفي ضوء تكلفة تقديم ضمانة العطاء، التي تُدرج عادة في سعر العقد، ينبغي النظر في استخدام بدائل لضمانة العطاء وتشجيع الأخذ بها عند الاقتضاء.

A supplier or contractor not wishing to submit a final tender may withdraw from the tendering proceedings without forfeiting any tender security that the supplier or contractor may have been required to provide.
ويجوز للمورد أو المقاول الذي لا يرغب في تقديم عطاء نهائي أن ينسحب من إجراءات المناقصة دون سقوط حقه في أي ضمان للعطاء كان قد اشترط على المورد أو المقاول تقديمه.
