1. Any State Party on whose territory a person suspected of having committed a forced disappearance or an act referred to in article 2 of this Convention is present shall, if after considering the information at its disposal it deems that the circumstances so warrant, take all necessary measures to ensure the continued presence of that person in the territory and if necessary take him or her into custody.
١- تتخذ أي دولة طرف يوجد في إقليمها شخص يشتبه في أنه ارتكب جريمة اختفاء قسري، أو فعل مشار إليه في المادة ٢ من هذه الاتفاقية، جميع التدابير اللازمة لكفالة استمرار وجود ذلك الشخص في إقليمها وإذا اقتضى اﻷمر وضعه في حراستها، إذا رأت بعد فحص المعلومات المتاحة لها أن الظروف تستلزم ذلك.

Upon being satisfied, after an examination of information available to it, that the circumstances so warrant, any State party in whose territory a person alleged to have committed any offence referred to in article 4 is present, shall take him into custody or take other legal measures to ensure his presence.
تقوم أية دولة طرف، لدى اقتناعها، بعد دراسة المعلومات المتوفرة لها، بأن الظروف تبرر احتجاز شخص موجود في أراضيها يدعى أنه اقترف جرماً مشاراً إليه في المادة 4 باحتجازه أو تتخذ أية إجراءات قانونية أخرى لضمان وجوده فيها.
