6.4 As to the claim that the conditions of detention to which the author was subjected during his period on death row violated articles 7 and 10, paragraph 1, the Committee notes that, in the absence of any explanation from the State party, it must give due weight to the author's allegations.
6-4 وبصدد الادعاء بأن ظروف الاحتجاز التي تعرض لها صاحب البلاغ خلال الفترة التي قضاها وهو في جناح المحكوم عليهم بالإعدام تمثل انتهاكاً للمادة 7 والفقرة 1 من المادة 10، تلاحظ اللجنة أنه في غياب أي تفسير من الدولة الطرف، يتعين عليها أن تولي مزاعم صاحب البلاغ الاهتمام الواجب.

That being so, while the procedure to which the author was subjected may raise issues under other provisions of the Covenant which the author has not invoked, the Committee considers that it therefore cannot conclude that the prohibition against retroactive criminal law in article 15, paragraph 1, of the Covenant was violated in the instant case.

11. Pursuant to article 2, paragraph 3 (a) of the Covenant, the Committee concludes that the author is entitled to an appropriate remedy to include protection from removal to the People's Republic of China without adequate assurances as well as adequate compensation for the length of the detention to which the author was subjected.
11- وعملاً بالفقرة 3(أ) من المادة 2 من العهد، تخلص اللجنة إلى أن لصاحبة البلاغ الحق في الحصول على سبيل انتصاف مناسب يؤمن لها الحماية من الإبعاد إلى جمهورية الصين الشعبية من دون ضمانات كافية، فضلاً عن تعويضها على نحو وافٍ عن فترة الاحتجاز الطويلة التي قضتها.

In the absence of any pertinent explanation from the State party, other than a blanket denial that its authorities had targeted the author, justifying the restrictions to which the author was subjected, pursuant to paragraph 3 of article 12, the Committee is of the opinion that the restrictions on the author's freedom of movement and residence were in violation of article 12, paragraph 1, of the Covenant.

وتحيط كذلك علماً بزعم الدولة الطرف أن صاحب البلاغ حُمّل المسؤولية الإدارية بموجب الجزء 3 من المادة 23-34 من قانون المخالفات الإدارية لأنه أخل بإجراءات تنظيم التجمعات الجماهيرية والقيام بها.

It further notes the State party's contention that the author was subjected to administrative liability under article 23.34, part 3, of the Code on Administrative Offences for having participated in an unauthorized picket, having previously been sentenced on a different occasion for a breach of the procedure for organizing and holding mass events.

3.4 It is submitted that the treatment to which the author was subjected on 28 May 1990, and the inadequate medical treatment he subsequently received, as well as the continuing fear of reprisals by warders, amount to a violation of articles 7 and 10, of the Covenant.
3-4 ويُدفع بأن المعاملة التي تعرض لها صاحب البلاغ في 28 أيار/مايو 1990، وعدم كفاية العلاج الطبي الذي تلقاه لاحقاً، فضلاً عن استمرار خوفه من انتقام السجانين منه يعتبر بمثابة انتهاك للمادتين 7 و10 من العهد.

The State party is under an obligation to take appropriate steps to (a) institute criminal proceedings, in view of the facts of the case, for the immediate prosecution and punishment of the persons responsible for the ill-treatment to which the author was subjected, and (b) provide the author with appropriate reparation, including compensation.

5.3 As to the treatment to which the author was subjected between 8 p.m. on 1 May 1989 and the early morning hours of 2 May 1989, it has remained uncontested that Mr. Kanana remained strapped to the concrete floor of his cell for close to four hours, and that he was thereafter subjected to acts of torture for several more hours.
٥-٣ أما فيما يتعلق بالمعاملة التي تعرض لها صاحب البلاغ من الساعة الثامنة من صباح يوم ١ أيار/مايو ٩٨٩١ وحتى الساعات المبكرة من صبيحة يوم ٢ أيار/مايو ٩٨٩١، فقد ظل من غير المنازع فيه أن السيد كانانا بقي مشدودا على بلاط زنزانته اﻷسمنتي طوال أربع ساعات تقريبا، وانه تعرض بعد ذلك ﻷعمال تعذيب طوال عدة ساعات أخرى.

202. In case No. 1890/2009 (Baruani v. Democratic Republic of the Congo), the Committee found that the treatment to which the author was subjected by officials of the national intelligence services, with the aim of obtaining a confession of his involvement with the Government of Rwanda and his plan to overthrow the Government of the Democratic Republic of the Congo, revealed a violation of article 7 of the Covenant.

7.4 Taking into account the author's detailed description of the events of 3 June 2003, the medical reports he submitted and the Public Prosecution Service's recognition that those events occurred, the Committee considers that the use of force by the police was disproportionate and that the treatment to which the author was subjected constitutes a violation of article 7 of the Covenant.
7-4 واعتباراً من اللجنة للعرض المفصّل الذي قدمه صاحب البلاغ للأحداث التي وقعت في 3 حزيران/يونيه 2003، والتقارير الطبية التي قدمها، وكذا اعتراف النيابة العامة بوقوع تلك الأحداث، ترى اللجنة أن استخدام الشرطة للقوة كان غير متناسب، وأن المعاملة التي خضع لها صاحب البلاغ تشكل انتهاكاً لأحكام المادة 7 من العهد.
