The parties, however, may wish to adopt decisions that might require increased funding. In particular, the Indonesian-Swiss country-led initiative to improve the effectiveness of the Basel Convention or the strategic framework decisions, if adopted, offers the possibility of significantly developing the work of the Convention but could require funding beyond what might be available in a flat growth budget.

In May 1997, the Indian Supreme Court decided that no import should be made or permitted by any authority or any person of any hazardous waste which is already banned under the Basel Convention or to be banned hereafter with effect from the date specified therein.

59 (2bis) If, following Article 2.1 of the Basel Convention or national legislation, at least one of the Parties involved in a transboundary movement has determined that used mobile phones destined for repair or refurbishment in the importing country are classified as wastes, then the decision tree procedure (see appendix 4 (b)) should be used.
