وتستند عتبة التكافؤ التقني للشهادات الأجنبية إلى اختبار قابلية التعويل عليها مقارنة بشروط قابلية التعويل التي وضعتها الدولة المشترعة وفقا للقانون النموذجي، بصرف النظر عن طبيعة مخطط التصديق المعتمد في الولاية القضائية التي صدرت منها الشهادة أو التوقيع.

In response, it was recalled that paragraph (1) only required the certification service provider to offer reasonably accessible means which enabled a relying party to ascertain, where relevant, from the certificate or otherwise whether means existed for a signatory to give the notices in question.

It was not the intention of draft article 12 to impose or exclude any of such approaches but rather to set forth criteria for the recognition of foreign certificates and electronic signatures, which would be valid and pertinent regardless of the nature of the certification scheme obtaining in the jurisdiction from which the certificate or signature emanated.
وأفيد بأن المقصود من مشروع المادة 12 ليس فرض أو استبعاد أي من هذه النهوج وانما المقصود منها هو تحديد معايير للاعتراف بالشهادات الأجنبية والتوقيعات الالكترونية تكون صالحة ووثيقة الصلة بصرف النظر عن طبيعة مخطط التصديق القائم في الولاية القانونية التي صدرت منها الشهادة أو التوقيع.

“(iii) any applicable certification practice statement stated or incorporated by reference in the certificate, or of which such person has notice, if any;
" `٣` أي بيان منطبق لممارسات التصديق ، مذكور في الشهادة أو مدرج فيها بالاشارة ، أو يكون ذلك الشخص قد أشعر به ان كان هناك أي اشعار به ؛

(b) name or identify the [signer][subject of the certificate] or a device or electronic agent under the control of [the signer] [the subject of the certificate] [that person];

The " life-cycle of the certificate " is intended to be interpreted broadly as covering the period starting with the application for the certificate or the creation of the certificate and ending with the expiry or revocation of the certificate.
والمقصود أن تفسر عبارة " دورة سريان الشهادة " تفسيرا واسعا باعتبارها تشمل المدة التي تبدأ بتقديم طلب الحصول على الشهادة أو انشاء الشهادة وتنتهي بانتهاء فترة سريان الشهادة أو الغائها.

That criterion is to apply regardless of the nature of the certification scheme obtaining in the jurisdiction from which the certificate or signature emanated (ibid., para. 29).

The view was expressed that the phrase " no regard shall be had [...] to the place where the certificate or the electronic signature was issued " was excessively categorical for the purposes of paragraph (1).
27- وأبدي رأي مفاده أن عبارة " لا يولى اعتبار للمكان الذي صدرت فيه الشهادة أو التوقيع الالكتروني " قاطعة بشكل مفرط لأغراض الفقرة (1).

" (d) provide reasonably accessible means which enable a relying party to ascertain, where relevant, from the certificate or otherwise:
" (د) أن يوفر وسائل يكون من المعقول الوصول إليها وتمكن الطرف المعوّل من التأكد، حسب الاقتضاء، من الشهادة أو من سواها، مما يلي:

“(1) By issuing a certificate, a certification authority represents to any person who reasonably relies on the certificate, or on a digital signature verifiable by the public key listed in the certificate, that:
" )١( باصدار الشهادة ، تؤكد سلطة التصديق ﻷي شخص يعتمد بدرجة معقولة على الشهادة أو على توقيع رقمي يمكن التحقق منه بواسطة المفتاح العام المبين في الشهادة ، ما يلي :

“(d) all information in the certificate is accurate as of the date it was issued, unless the certification authority has stated in the certificate [or incorporated by reference in the certificate a statement] that the accuracy of specified information is not confirmed; and
" )د( أن جميع المعلومات الواردة في الشهادة معلومات دقيقة في تاريخ اصدار الشهادة ، ما لم تكن سلطة التصديق قد ذكرت في الشهادة ]أو أدرجت بالاشارة في الشهادة بيانا مفاده[ أنها لا تؤكد دقة معلومات معينة ؛ و

It was, therefore, suggested that a provision introducing an aggregate liability limit should be included in draft article 12 that could read along the following lines: “A certification authority may, in the certificate or otherwise, provide a limit of liability for the lifetime of the certificate for all incidents of reliance in the amount of an aggregate value of the certificate.
لذلك اقترح أن يدرج في مشروع المادة ٢١ حكم يستحدث حدا اجماليا للمسؤولية ، يمكن أن يكون نصه على غرار ما يلي : " يجوز لسلطة التصديق أن تضع ، في الشهادة أو بطريقة أخرى ، حدا للمسؤولية ، طوال عمر الشهادة ، عن جميع حالات الاعتماد ، بمبلغ يعادل القيمة الاجمالية للشهادة .

“(2) A certification authority may state in the certificate [or elsewhere] a restriction on the purpose or purposes for which the certificate may be used and the certification authority shall not be liable for damage arising from use of the certificate for any other purpose.
" )٢( يجوز لسلطة التصديق أن تبين في الشهادة ]أو في موضع آخر[ قيدا على ما يجوز أن تستخدم فيه الشهادة من غرض أو أغراض ، ولا تكون سلطة التصديق مسؤولة عن الضرر الناجم عن استخدام الشهادة ﻷي غرض آخر .

“(2) Reliance on a certificate is not reasonable to the extent that it is contrary to the information contained [or incorporated by reference] in the certificate [or in a revocation list] [or in the revocation information]. [Reliance is not reasonable, in particular, if:
" )٢( إن الاعتماد على الشهادة لا يكون معقولا بقدر ما يكون متعارضا مع المعلومات الواردة ]أو المدرجة باﻹشارة[ في الشهادة ]أو في قائمة إلغاء[ ]أو في معلومات عن اﻹلغاء[. ]إن الاعتماد لا يكون معقولا، بصفة خاصة، إذا:

In view of the similarities in their contents, it was agreed that they should be merged into one subparagraph, which would read along the following lines: “exercise due diligence to ensure the accuracy and completeness of all material representations made by the information certifier that are relevant to the life-cycle of the certificate, or which are certified in the certificate”.
وبالنظر الى أوجه التشابه في مضمونهما ، اتفق على أنه ينبغي دمجهما في فقرة فرعية واحدة ، يكون نصها على النحو التالي : " ممارسة الحرص الواجب لضمان دقة واكتمال كل التأكيدات الجوهرية المقدمة من جهة التصديق على المعلومات التي تكون ذات صلة بدورة عمر الشهادة أو التي صدق عليها في الشهادة " .

“(2) Notwithstanding paragraph (1), a certification authority is not liable if it can demonstrate that the certification authority or its agents have taken all necessary measures to avoid errors in the certificate or that it was impossible for the certification authority or its agents to take such measures.
" )٢( بالرغم مما تنص عليه الفقرة )١( ، لا تكون سلطة التصديق مسؤولة اذا استطاعت أن تبرهن على أنها هي أو وكلاؤها قد اتخذوا كل التدابير اللازمة لتجنب وقوع أخطاء في شهادة التصديق أو أنه كان يستحيل على سلطة التصديق أو وكلائها اتخاذ هذه التدابير ؛

“(3) Notwithstanding paragraph (1), a certification authority may, in the certificate [or otherwise], limit the purpose for which the certificate may be used.
