First, the Panel is called upon to interpret the clause “without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990” (hereinafter referred to as the “arising prior to” clause).

The clause in paragraph 16 of resolution 687 (1991) relating to " the debts and obligations of Iraq arising prior to 2 August 1990 " (the " arising prior to " clause) has been interpreted by this Panel in its first report.
25- وقد فسر الفريق في تقريره الأول الشرط المنصوص عليه في الفقرة 16 من القرار 687 (1991) بشأن " ديون والتزامات العراق الناشئة قبل 2 آب/أغسطس 1990 " (شرط " الناشئة قبل " ).

(a) The phrase " without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990, which will be addressed through normal mechanisms " was intended to have an exclusionary effect on the Commission's jurisdiction, i.e. that such debts and obligations could not be brought before the Commission;
(أ) أُريد بالعبارة " دون المساس بديون العراق والتزاماته الناشئة قبل 2 آب/أغسطس 1990 والتي سيجري تناولها عن طريق الآليات العادية " أن يكون لها أثر استبعادي في ولاية اللجنة، أي أن هذه الديون والالتزامات لا يمكن أن تعرض على اللجنة؛

The clause “without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990, which will be addressed through the normal mechanisms” is not understood by such Governments to restrict the scope of the Commission’s jurisdiction.
أما عبارة " دون المساس بديونه والتزاماته الناشئة قبل ٢ آب/أغسطس ٠٩٩١ والتي سيجري تناولها عن طريق اﻵليات العادية " فلا تفهم منها تلك الحكومات أنها تقيد نطاق اختصاص اللجنة.

Iraq, without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990, which will be addressed through the normal mechanisms, is liable under international law for any direct loss, damage ... or injury to foreign Governments, nationals and corporations, as a result of Iraq’s unlawful invasion and occupation of Kuwait”.
العراق، دون المساس بديون والتزامات العراق الناشئة قبل 2 آب/أغسطس 1990 والتي سيجري تناولها عن طريق الآليات العادية، مسؤول بمقتضى القانون الدولي عن أي خسارة مباشرة أو ضرر مباشر، ... أو ضرر وقع على الحكومات الأجنبية أو رعاياها أو شركاتها، نتيجة لغزو العراق واحتلاله غير المشروعين للكويت " .

As noted by the Panel in paragraph above, in paragraph 16 of resolution 687 (1991), the Security Council reaffirmed that Iraq was liable for any direct loss, damage or injury resulting from its invasion and occupation of Kuwait " without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990, which will be addressed through the normal mechanisms " .
26- كما لاحظ الفريق في الفقرة 14 أعلاه، فقد أكد مجلس الأمن من جديد في الفقرة 16 من قراره 687(1991)، أن العراق، " دون المساس بديونه والتزاماته الناشئة قبل 2 آب/أغسطس 1990 والتي سيجري تناولها عن طريق الآليات العادية " مسؤول عن أي خسارة مباشرة أو ضرر مباشر نتيجة لغزوه واحتلاله للكويت.
