With respect to future work in the field of settlement of commercial disputes, Morocco favoured the revision of the UNCITRAL Arbitration Rules. It also encouraged the Commission to examine the issue of arbitrability.

With respect to future work in the field of settlement of commercial disputes, the Commission recalled that, at its thirty-ninth session, it had agreed that the issue of arbitrability was a topic that the Working Group should also consider.

With respect to future work in the field of settlement of commercial disputes, the Commission recalled that the issue of arbitrability should be maintained by the Working Group on its agenda, as decided by the Commission at its thirty-ninth session. Further, the Commission heard a suggestion that the issue of confidentiality might need to be further examined.

The Commission took note of document A/CN.9/785, on possible future work in the field of settlement of commercial disputes, and held a preliminary discussion regarding work that could be recommended in the field of international arbitration in view of the consideration of that matter by the Commission under agenda item 16 (see paras. 292 to 332 below).

With respect to future work in the field of settlement of commercial disputes, the Commission recalled its earlier decision that the question of transparency in treaty-based investor-State arbitration should be dealt with as a matter of priority immediately after completion of the current revision of the UNCITRAL Arbitration Rules, as decided by the Commission at its forty-first session (see para. 290 above).
