2. In the exercise of his rights and freedoms, everyone shall be subject only to such limitations as are determined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society.
٢- لا يخضع أي فرد، في مارسة حقوقه وحرياته، إلا للقيود التي يقررها القانون مستهدفاً منها، حصراً ضمان الاعتراف الواجب بحقوق وحريات اﻵخرين واحترامها، والوفاء بالعادل من مقتضيات الفضيلة والنظام العام ورفاه الجميع في مجتمع ديمقراطي.

Any restrictions must therefore be proportional, in accordance with the law, including international human rights standards, compatible with the nature of the rights protected by the Covenant, in the interest of legitimate aims pursued; and strictly necessary for the promotion of the general welfare in a democratic society.

53. The States parties to the Covenant recognize that, in the exercise of the rights guaranteed under the Covenant, the latter may subject such rights only to limitations determined by law, and only insofar as is compatible with the nature of those rights and with the exclusive aim of promoting the general welfare in a democratic society.
53- تُقِرّ الدول الأطراف في هذا العهد بأنه ليس للدولة أن تخضع التمتع بالحقوق التي تضمنها طبقاً لهذا العهد إلا للحدود المقررة في القانون، وإلا بمقدار توافق ذلك مع طبيعة هذه الحقوق، وشريطة أن يكون هدفها الوحيد تعزيز الرفاه العام في مجتمع ديمقراطي.

25. Article 4 of ICESCR authorizes " limitations as are determined by law only in so far as this may be compatible with the nature of these rights and solely for the purpose of promoting the general welfare in a democratic society. "

On the other hand, article 4 of the International Covenant on Economic, Social and Cultural Rights established that " the State may subject such rights only to such limitations as are determined by law only insofar as this may be compatible with the nature of these rights and solely for the purpose of promoting the general welfare in a democratic society " .

Even in situations where it may be necessary to impose limitations on such a right, full compliance with article 4 of the Covenant is required so that any limitations imposed must be “determined by law only insofar as this may be compatible with the nature of these [i.e. economic, social and cultural] rights and solely for the purpose of promoting the general welfare in a democratic society”.

23. The Court concluded that the restrictions on the enjoyment by the Palestinians living in the territory occupied by Israel of their economic, social and cultural rights, resulting from the construction of the wall by Israel failed to meet a condition laid down by article 4 of the Covenant, that their implementation must be " solely for the purpose of promoting the general welfare in a democratic society " .
23- وانتهت المحكمة إلى أن القيود المفروضة على تمتع الفلسطينيين الذين يعيشون في الأراضي التي تحتلها إسرائيل بحقوقهم الاقتصادية والاجتماعية والثقافية، والناتجة عن تشييد إسرائيل للجدار، لا تفي بالشرط الوارد في المادة 4 من العهد وهو أن تطبيقها يجب أن يكون " هدفه الوحيد تعزيز الرفاه العام في مجتمع ديمقراطي " .

17- وتنص الفقرة 2 من المادة 29 من الإعلان العالمي على أنه لا يخضع أي فرد، في ممارسة حقوقه وحرياته، إلا للقيود التي يقررها القانون مستهدفاً منها، حصراً، ضمان الاعتراف الواجب بحقوق وحريات الآخرين واحترامها، والوفاء بالعادل من مقتضيات الفضيلة والنظام العام ورفاه الجميع في مجتمع ديمقراطي.

We also reaffirm Article 29 of the Universal Declaration of Human Rights and the right of Member States to enact laws that meet " just requirements of morality, public order and the general welfare in a democratic society " .
وكذلك نعيد تأكيد المادة 29 من الإعلان العالمي لحقوق الإنسان وحق الدول الأعضاء في سن قوانين تفي " بالعادل من مقتضيات الفضيلة والنظام العام ورفاه الجميع في مجتمع ديمقراطي " .

27. The African Group reaffirmed its support for the right of Member States to enact laws that met " just requirements of morality, public order and the general welfare in a democratic society " , as enshrined in article 29 of the Universal Declaration of Human Rights.
27 - ومضت تقول إن مجموعة الدول الأفريقية تعيد تأكيد دعمها لحق الدول الأعضاء في سن القوانين التي تكفل " الوفاء بالعادل من مقتضيات الفضيلة والنظام العام ورفاه الجميع في مجتمع ديمقراطي " حسبما تنص على ذلك المادة 29 من الإعلان العالمي لحقوق الإنسان.
