The Committee notes that although Guatemala has been a State party to the Convention since 5 January 1990 it has not made the declarations provided for in articles 21 and 22 of the Convention, and that it is also a party to the Inter-American Convention to Prevent and Punish Torture.

Other regional instruments such as the Inter-American Convention to Prevent and Punish Torture and the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment provide expanded provisions relating to torture and cruel, inhuman or degrading treatment or punishment, and indicate measures that States should take to prevent and penalize such practices.

According to another viewpoint, paragraph 3 should be deleted because acts committed in a private capacity were not covered by the definitions of torture in the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment of 10 December 1984 or the Inter-American Convention to Prevent and Punish Torture of 9 December 1985.

The State party’s accession to the Inter-American Convention to Prevent, Sanction and Eradicate Violence against Women, the enactment of Law 26260 for protection against domestic violence, and of Law 27055 containing reforms criminalizing sexual violence issues are regarded as positive steps to combat violence against children and for the treatment of victims, in line with the Committee’s recommendation (ibid.).

The State party's accession to the Inter-American Convention to Prevent, Sanction and Eradicate Violence against Women (Belem do Pará, 1995), the Hague Convention on the Civil Aspects of International Child Abduction (1994) and the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on Their Destruction (2000) is regarded as a positive measure.

25. OMCT noted that a Federal Law to Prevent and Punish Torture is in force since 1991, however, the State has failed to bring domestic legislation and the definition of torture in compliance with the UN Convention against Torture and the Inter-American Convention to Prevent and Punish Torture.

The Fund has been complemented by a series of international legal obligations that explicitly prohibit torture, including those in the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and its Optional Protocol, the Inter-American Convention to Prevent and Punish Torture and the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment and its protocols.

In addition to the Convention, El Salvador was a party to other international instruments such as the Inter-American Convention on the Granting of Civil Rights to Women, the Inter-American Convention to Prevent, Punish and Eradicate Violence against Women, and the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children of the United Nations Convention against Transnational Organized Crime.
