The Court held that, pursuant to article 4 CISG, the Convention is not concerned with issues of representation. The matter was thus to be settled in conformity with the law applicable by virtue of the rules of private international law.
وذكرت المحكمة العليا أنه وفقا للمادة 4 من اتفاقية البيع، لا تتناول الاتفاقية مسائل التمثيل، ومن ثم ينبغي البت في هذه القضية وفقا للقانون المنطبق بمقتضى قواعد القانون الدولي الخاص.

2- أما المسائل المتعلقة بالقضايا التي تنظمها هذه الاتفاقية والتي لم يتمّ تسويتها صراحة فيها، فينبغي أن يُصار إلى البتّ بها وفقا للمبادئ العامة التي تقوم عليها، أو، في غياب هذه المبادئ، وفقا للقوانين المرعية الإجراء بمقتضى قواعد القانون الدولي الخاص.

Such decisions often invoke choice of law principles to determine the applicable national law, and they frequently cite the directive in article 7 (2) that issues within the scope of the CISG which are settled neither by its express provisions nor by the general principles on which it is based should be determined " in conformity with the law applicable by virtue of the rules of private international law " .

The Court held that, although article 78 of CISG did not establish a dies a quo for arrears to be paid, article 7.2 provided that questions that were not expressly settled in the Convention were to be settled in conformity with the general principles on which it was based or, in the absence of such principles, in conformity with the law applicable by virtue of the rules of private international law.
ومع أنَّ المادة 78 من اتفاقية البيع لا تُحدِّد موعدا لبدء دفع المتأخرات، فقد رأت المحكمة أنَّ الفقرة 2 من المادة 7 تنص على أنَّ المسائل التي لم تُحسم بوضوح في اتفاقية، تُسوّى وفقا للمبادئ العامة التي استندت إليها، أو وفقا للقانون الواجب التطبيق بمقتضى أحكام القانون الدولي الخاص في حالة عدم وجود تلك المبادئ.

It follows from Article 7(2) CISG that the rate of interest, being an " internal gap " should be established in conformity with the law applicable by virtue of the rules of private international law of the forum, since there are no general principles in that regard.
ويُستنتج من المادة 7 (2) من اتفاقية البيع أنَّ معدل الفائدة، باعتبار كونه " ثغرة داخلية " ، ينبغي تحديده وفقا للقانون الواجب تطبيقه بحكم قواعد القانون الدولي الخاص للمحكمة، وذلك لعدم وجود مبادئ عامة في هذا الشأن.
