8.1 In his comments on the State party's submission, counsel to the author submits that the State party's interpretation of section 25 of the Municipalities Act, that the incompatibility is limited to those police officers who are elected to the council of the municipality in which they are employed, is too narrow.
٨-١ ويرد محامي صاحب البلاغ على ما سبق، في تعليقاته على رسالة الدولة الطرف، بأن تفسير الدولة الطرف للمادة ٥٢ من قانون البلديات الذي تذهب فيه إلى أن التعارض يقتصر على ضباط الشرطة الذين ينتخبون في مجلس البلدية التي يعملون في دائرتها، هو تفسير ضيﱢق بشكل مبالغ فيه.

وتدﱠعي أن اﻷحكام الواردة في المادة ٥٢ من قانون البلديات والمنظﱢمة لاتفاق المناصب مع عضوية المجلس البلدي أحكام معقولة تماما، وأن حماية الاجراءات الديمقراطية لاتخاذ القرارات تقضي بمنع اﻷفراد الذين يشغلون مناصب معينة من عضوية المجالس البلدية إذا كانت هذه العضوية تهدد بصورة غير مقبولة بحدوث تعارض بين المصالح.
