3.2 The authors draw the attention of the Committee to the fact that neither the National Immigration Board nor the Aliens Appeal Board has questioned that S.M.R. had been active in the Mujahedin organization and that she had previously been imprisoned and tortured.
٣-٢ ويسترعي مقدما البلاغ انتباه اللجنة إلى أن المجلس الوطني للهجرة ومجلس طعون اﻷجانب لم ينكرا كلاهما أن س. م. ر. كانت نشطة في منظمة مجاهدي خلق وأنها سجنت وعذبت قبل ذلك.

4.10 In its decision of 30 January 1996, the National Immigration Board noted that S.M.R. had been released from prison in 1990 for lack of evidence.
٤-٨ وقد لاحظ المجلس الوطني للهجرة في قراره المؤرخ ٣٠ كانون الثاني/يناير ١٩٩٦، أن س. م. ر. غادرت السجن في عام ١٩٩٠ بسبب عدم كفاية اﻷدلة.

9.5 The Committee does not share the view of the National Immigration Board that it is unlikely that S.M.R. held regular meetings at her home without her husband’s knowledge.

4.1 By submission of 20 February 1998, the State party informs the Committee that, following the Committee’s request under rule 108, paragraph 9, of its rules of procedure, the National Immigration Board decided to stay the expulsion order against the author while his communication is under consideration by the Committee.
٤-١ أبلغت الدولة الطرف اللجنة، في مذكرة مؤرخة ٢٠ شباط/فبراير ١٩٩٨، أن المجلس الوطني للهجرة قرر، إثر طلب اللجنة بموجب الفقرة ٩ من المادة ١٠٨ من نظامها الداخلي، وقف تنفيذ أمر اﻹبعاد الصادر ضد مقدم البلاغ ما دامت اللجنة تنظر في بلاغه.

4.1 By its submission of 21 April 1998, the State party informed the Committee that, following the Committee’s request under rule 108, paragraph 9, of its rules of procedure, the National Immigration Board had decided to stay the expulsion order against the authors while their communication is under consideration by the Committee.
٤-١ أبلغت الدولة الطرف اللجنة، في مذكرتها المؤرخة ٢١ نيسان/أبريل ١٩٩٨، أن المجلس الوطني للهجرة قرر، إثر الطلب الذي قدمته اللجنة بموجب الفقرة ٩ من المادة ١٠٨ من نظامها الداخلي، وقف أمر الطرد الصادر ضد مقدمي البلاغ ما دامت اللجنة تنظر في بلاغهما.

4.9 As regards its assessment of whether or not the author would be personally at risk of being subjected to torture if returned to the Islamic Republic of Iran, the State party relies on the evaluation of the facts and evidence made by the National Immigration Board and the Aliens Appeal Board.
٤-٧ وفيما يتعلق بتقدير الدولة الطرف لما إذا كان مقدما البلاغ سيتعرضان شخصيا للتعذيب فيما لو أعيدا إلى جمهورية إيران اﻹسلامية، تعتمد الدولة الطرف على تقييم الوقائع واﻷدلة من جانب المجلس الوطني للهجرة ومجلس طعون اﻷجانب.

R. G.’s application for refugee status was rejected by the National Immigration Board on 30 November 1992, and her appeal was rejected on 21 July 1994.
ورفض مجلس الهجرة الوطني طلب ر. ج. للحصول على وضع لاجئة في ٣٠ تشرين الثاني/نوفمبر ١٩٩٢، ورفض استئنافها في ٢١ تموز/يوليه ١٩٩٤.

4.9 The author further contended that the assertion in the decision of the National Immigration Board that he had retired was not correct, since he was too young to retire.
٤-٩ وادعى مقدم البلاغ كذلك أن التأكيد في قرار مجلس الهجرة الوطني بأنه أحيل إلى التقاعد ليس صحيحا، ﻷنه كان شابا ولم يبلغ سن التقاعد.

6.4 In the case under consideration the Committee notes the statement of the National Immigration Board that the author was not entitled to asylum in accordance with the Convention relating to the Status of Refugees in view of the fact that he had admitted having committed the kind of crimes referred to in article 1 F of the said Convention.
٦-٤ في الحالة قيد النظر، تلاحظ اللجنة أنه في بيان مجلس الهجرة الوطني بأنه لا يحق لمقدم البلاغ الحصول على اللجوء وفقا للاتفاقية المتعلقة بمركز اللاجئين ﻷنه اعترف بأنه ارتكب نوعا من الجرائم المشار إليها في المادة ١ واو من الاتفاقية المذكورة.
