5. 14. The procurement regulations should explain limits on the extent of modification of the terms and conditions of the procurement as set out at the outset of the procurement proceedings during the dialogue, taking into account that flexibility in making modifications is an inherent feature of this method and imposing excessive restrictions will defeat the purpose of the procedure.

The article in paragraph (1) therefore provides important safeguards that ensure that equal requirements on the manner, place and deadline for submission of documents to the procuring entity apply to all suppliers or contractors, and that they are specified at the outset of the procurement proceedings in the pre-qualification, preselection or solicitation documents, as applicable.
