Indeed, the provisions of the Rome Statute follow this approach as article 8 (2) (b) (viii) refers clearly to the " deportation or transfer of all or parts of the population of the occupied territory within or outside this territory " .

In addition, article 85 (4) (a) of Protocol I typifies the wilful “... transfer of all or parts of the population of the occupied territory within ... this territory, in violation of Article 49 of the Fourth Convention” as a grave breach of the Protocol.
