8.10 As regards the issue of whether the relevant national law has been applied in accordance with the Convention in the present case, the State party refers to the jurisprudence of the European Court of Human Rights. According to that jurisprudence, a State is allowed a certain measure of discretion, subject to European supervision, when it takes legislative, administrative, or judicial action in the area of Convention rights.
