The principle, enshrined in paragraph 10 of article 16, requires that where extradition is refused solely on the ground of nationality, the requested State Party will be ready to prosecute the person in his or her own territory.

The delegation of Bangladesh suggested that the modalities for sharing ordinary costs of executing the request should be decided through mutual consultation between the requesting State Party and the requested State Party.

(d) If the requesting State Party deems the clarification to be inadequate, it shall have the right to request the Executive Council to obtain from the requested State Party further clarification.

2. If a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, the requested State Party may at its option consider this Convention as a legal basis for extradition in respect of the offences set forth in article 1.
