Since, given its commitment to the principles of Islamic law, the United Arab Emirates does not permit the system of adoption, it has reservations with respect to this article and does not deem it necessary to be bound by its provisions.
نظراً إلى أن اﻹمارات العربية المتحدة لا تبيح نظام التبني بموجب التزامها بمبادئ الشريعة الاسلامية، فإن لديها تحفظات على هذه المادة ولا تعتبر من الضروري أن تلتزم بأحكامها.

213. The Committee recommends that the State party introduce the measures necessary to monitor and supervise effectively the system of adoption of children in the light of article 21 of the Convention.

Indeed, the system of filiation was considered by many as superior to the system of adoption and, in that regard, it should be remembered that article 41 of the Convention stipulated that nothing in the Convention should affect any provisions which were more conducive to the realization of the rights of the child and which might be contained in the law of a State party.

Article 21 expressly refers to those States that " recognize and/or permit " the system of adoption, which does not apply to the State party because it does not recognize the system of adoption.
وتشير المادة 21 صراحة إلى الدول التي تقر و/أو تجيز نظام التبني، وهو ما لا ينطبق على الدولة الطرف لأنها لا تقر نظام التبني.

13. The Syrian legislature has created an alternative to the system of adoption under the terms of the Act promulgated by Legislative Decree No. 107 of 4 May 1970.
13- وقد أوجد التشريع السوري بديلاً عن نظام التبني وذلك بالقانون الصادر بالمرسوم التشريعي رقم 107 تاريخ 4 أيار/مايو 1970، فعرّف اللقيط المولود الحي بأنه الوليد الذي يعثر عليه ولم يعرف والداه.

The concept of filiation is similar to the system of adoption, the difference between them lying in the fact that, under the adoption system, one or both of the parents must be known whereas, under the filiation system, the filiated child must be of unknown parentage or the offspring of an unlawful marriage.
ويتقارب مفهوم الاقرار بالنسب من نظام التبني، والفرق بينهما هو أنه في نظام التبني يكون الوالدان أو أحدهما معروفا، بينما في الاقرار بالنسب يجب أن يكون الولد المقر له بالنسب مجهول الوالدين، أو كان ثمة زواج غير شرعي.

٣٨- يُرجى بيان التدابير التي اتُخذت بما فيها التدابير ذات الطابع التشريعي أو اﻹداري أو القضائي والتي تكفل إيلاء مصالح الطفل الفضلى الاعتبار اﻷول حين تُقر الدولة نظام التبني و/أو تُجيزه.

(b) Take the necessary measures to monitor and supervise effectively the system of adoption of children in accordance with the principle of the best interest of the child;
(ب) اتخاذ التدابير الضرورية لرصد نظام التبني والإشراف عليه بصورة فعالة طبقاً لمبدإ مصالح الطفل الفضلى؛

105. The Institute considered that the system of adoption should continue as it is handled by lawyers who know the procedure because to transfer control to the State would encourage corruption and lessen the possibility of children finding a family.
105- وكــان من رأي معهد قانون الأسرة أن يستمر نظام التبني على حاله - يُعنى به محامون على علم بإجراءاته - لأن جعل الرقابة على التبني من سلطة الدولة يشجع على الفساد ويقلل من احتمال العثور على أسر تتبنى الأطفال.

In fact, the concerns expressed by the State party in its reservation are well taken care of by article 20, paragraph 3 of the Convention, which expressly recognizes kafalah of Islamic law as alternative care, and article 21 expressly refers to States parties that " recognize and/or permit the system of adoption " .
والواقع أن الفقرة 3 من المادة 20 من الاتفاقية تراعي كما ينبغي الشواغل التي أعربت عنها الدولة الطرف في تحفظها، إذ تعترف بالكفالة الواردة في القانون الإسلامي كإحدى وسائل الرعاية البديلة، كما أن المادة 21 تشير بوضوح إلى الدول الأطراف التي " تُقر و/أو تجيز نظام التبني " .

With regard to the State party's reservation to article 21 of the Convention, the Committee notes that concerns expressed by the State party in its reservation are well taken care of by article 21 which expressly refers to States parties which " recognize and/or permit the system of adoption " .
أما فيما يخص تحفظ الدولة الطرف على المادة 21 من الاتفاقية، فتلاحظ اللجنة أن دواعي القلق التي أعربت عنها الدولة الطرف في تحفظها قد روعيت على النحو الواجب في المادة 21 من الاتفاقية التي تشير صراحة إلى الدول الأطراف التي " تُقر و/أو تجيز نظام التبني " .

Article 21 of the Convention on the Rights of the Child provides that States parties that recognize and/or permit the system of adoption shall ensure that the best interests of the child shall be the paramount consideration and sets out certain conditions to ensure the safeguard of the child in both national and intercountry adoption processes.
34- تنص المادة 21 من اتفاقية حقوق الطفل على أن تضمن الدول التي تقر و/أو تجيز نظام التبني إيلاء مصالح الطفل الفضلى الاعتبار الأول، وتحدد شروطاً معينة لضمان صون مصالح الطفل في إطار عمليات التبني على الصعيدين الوطني والدولي.

The State of Qatar does not recognize the system of adoption referred to in article 21 of the Convention, as it is contrary to the provisions of the Islamic Shari'a.
76- لا تأخذ دولة قطر بنظام التبني المنصوص عليه في المادة 21 من الاتفاقية لأنه مخالف لأحكام الشريعة الإسلامية.

There appeared to be no need for the reservation to article 21 on adoption since the article applied only to States parties that recognized and/or permitted the system of adoption.
ويبدو أنه لا حاجة إلى التحفظ على المادة ١٢ بشأن التبني، ما دامت المادة لا تنطبق إلا على الدول اﻷطراف التي تعترف و/أو تسمح بنظام التبني.

132. The Committee recommends that the State party introduce the necessary measures to effectively monitor and supervise the system of adoption of children, in the light of article 21 of the Convention.
132- وتُوصِي اللجنة الدولة الطرف باتخاذ التدابير اللازمة لرصد نظام تبني الأطفال والإشراف عليه بصورة فعالة وذلك في ضوء المادة 21 من الاتفاقية.

556. The Committee recommends that the State party take all necessary measures to protect adopted children even in the extended family, including by establishing a system to monitor and supervise effectively the system of adoption of children, in the light of article 21 of the Convention.
556- توصي اللجنة الدولة الطرف باتخاذ جميع التدابير الضرورية لحماية الأطفال المتبنين حتى في الأسر الممتدة، بما في ذلك عن طريق إنشاء نظام للإشراف على عمليات تبني الأطفال ورصدها بفعالية على ضوء المادة 21 من الاتفاقية.
