VII. INTERPRETATION AND APPLICATION OF the Transfer Agreements BETWEEN THE FUND AND THE FORMER UNION OF

The Fund and the Board had met their obligations under the Transfer Agreements to the former Fund participants concerned.

The Secretary had therefore been authorized to initiate discussions with the permanent missions to the United Nations of the three Member States concerned with a view to determining the extent to which the concerns that had arisen in the application of the Transfer Agreements could be resolved.

Background information 201. Since 1991, the Board has reported to the General Assembly on problems arising from the past application of the Transfer Agreements which the Fund had concluded with the Governments of the former USSR, the Ukrainian SSR and the Byelorussian SSR.

I refer to our previous correspondence concerning the application of the Transfer Agreements between the United Nations Joint Staff Pension Fund and the Governments of the former USSR, Ukrainian SSR and Byelorussian SSR.

We informed them of the status of our discussions with representatives of the Russian Federation and, in particular, of their firm position that they could only address the situation of Russian citizens and could not enter into any agreement concerning citizens of the other now independent States affected by the Transfer Agreements.

The Board will in all likelihood also have before it for consideration draft transfer agreements with international organizations, subject to the concurrence of the General Assembly, and a report on the status of the Transfer Agreements between the Fund and the former Union of Soviet Socialist Republics, the Ukrainian SSR and the Byelorussian SSR.

The Board therefore adopted the principle that former participants who had availed themselves of the Transfer Agreements should not be placed in a worse position with respect to restoration than other re-entrants, even though they had opted to transfer their entitlements rather than taking a benefit from the Fund when their prior period of service ended.

(a) It noted the views of the United Nations Legal Counsel as to the legal responsibilities and obligations of the Board under the Transfer Agreements:

The Board reiterated its deep concern and sympathy for the difficult conditions faced by the former Fund participants whose UNJSPF pension rights had been transferred to the USSR Social Security Fund under the Transfer Agreements and who were now facing acute hardships.
٧٤٢ - وأعرب المجلس مرة اخرى عن بالغ قلقه وتعاطفه إزاء الظروف الصعبة التي يواجهها المشتركون السابقون في الصندوق الذين نقلت استحقاقات تقاعدهم في الصندوق الى صندوق الضمان الاجتماعي في الاتحاد السوفياتي بموجب اتفاقات النقل والذين يواجهون حاليا صعوبات كبيرة.

" The moneys remitted by the UNJSPF on behalf of the UNJSPF participants from the former USSR, whether under the Transfer Agreements or earlier, were absorbed in and credited to the USSR national budget.
" إن اﻷموال التي نقلها مجلس الصندوق المشترك للمعاشات التقاعدية نيابة عن المشتركين في الصندوق، من مواطني اتحاد الجمهوريات الاشتراكية السوفياتية سابقا، سواء بموجب اتفاقات النقل أو قبلها، الى الميزانية الوطنية لاتحاد الجمهوريات الاشتراكية السوفياتية، قد تم استيعابها فيها وقيدت لحسابها.

Since the General Assembly had concurred in the conclusion of the Transfer Agreements in question, in accordance with article 13 of the Fund's Regulations, the Board has felt it important to report to the Assembly continuously and extensively on the problems which have arisen as regards their implementation, as seen by those most directly affected.
٢٥٢ - ومنذ أن وافقت الجمعية العامة على إبرام اتفاقات النقل المشار إليها أعلاه، وفقا للمادة ١٣ من النظام اﻷساسي للصندوق، رأى المجلس أن من اﻷهمية بمكان أن يقدم تقريرا إلى الجمعية العامة بصورة مستمرة وبطريقة مستفيضة بشأن المشاكل التي نشأت فيما يتعلق بتنفيذها، كما يراها أكثر المتضررين بصورة مباشرة.

(b) The Board also recommends that the Assembly concur with the Transfer Agreements negotiated with Eurocontrol and OSCE (see paras. 52-55);
(ب) كما يوصي الصندوق بأن توافق الجمعية العامة على اتفاقات النقل التي تم التفاوض عليها مع المنظمة الأوروبية لسلامة الملاحة الجوية ومنظمــــة الأمــــن والتعاون في أوروبا (انظر الفقرات 52-55)؛

6.
