3. When such ships destined for shipbreaking involve a transboundary movement, i.e., move from an area under the national jurisdiction of one State party to or through an area under the national jurisdiction of another State party, they are subject to the Basel Convention (and other applicable regional hazardous waste trade regimes).

The wastes regulated are further clarified in the annexes to the Convention. Transboundary movements are defined in Article 2 (3) as " any movement of hazardous wastes or other wastes from an area under the national jurisdiction of one State to or through an area under the national jurisdiction of another State or through an area not under the national jurisdiction of any State, provided at least two States are involved in the movement " .
7- والنقل عبر الحدود معرف في المادة 2 (3) بأنه " أي حركة لنفايات خطرة أو لنفايات أخرى من منطقة خاضعة للولاية القضائية الوطنية لدولة ما إلى أو عبر منطقة خاضعة للولاية القضائية الوطنية لدولة أخرى أو إلى أو عبر منطقة لا تخضع للولاية القضائية الوطنية لأي دولة، شريطة أن تتورط دولتان على الأقل في هذه الحركة " .
