21. According to paragraph 1 of Article 4, the information should be made available to the party in control of the affected area bilaterally or through a mutually agreed third party, such as the United Nations or other relevant organizations with whom the party providing information is satisfied that the actions to protect civilians would be undertaken.

The Protocol establishes obligations for the users of munitions that may become explosive remnants of war, not only to record and retain information on the use or abandonment of explosive ordnance, but also to transmit such information to the party in control of the affected area.

The objective is, as specified in Article 4.1, " to facilitate the rapid marking and clearance, removal and destruction of explosive remnants of war, risk education and the provision of information to the party in control of the territory and to civilian populations in that territory " .

High Contracting Parties and parties to the conflict shall, as far as practicable, record and retain information concerning explosive remnants of war, to facilitate the rapid clearance, removal or destruction of explosive remnants of war, risk education and the provision of relevant information to the party in control of the territory and to civilian populations in that area.

With respect to minefields, mined areas, mines, booby-traps and other devices laid by a party in areas over which it no longer exercises control, such party shall provide to the party in control of the area pursuant to paragraph 2 of this Article, to the extent permitted by such party, technical and material assistance necessary to fulfil such responsibility.
3- فيما يتعلق بحقول الألغام والمناطق الملغومة والألغام والأشراك الخداعية والنبائط الأخرى التي زرعها طرف في مناطق لم يعد يمارس السيطرة عليها، يجب على هذا الطرف أن يوفر للطرف المسيطر على المنطقة بموجب الفقرة 2 أعلاه، في حدود ما يسمح به هذا الطرف، المساعدة التقنية والمادية اللازمة للنهوض بهذه المسؤولية.

3. With respect to minefields, mined areas, mines, booby-traps and other devices laid by a party in areas over which it no longer exercises control, such party shall provide to the party in control of the area pursuant to paragraph 2 of this Article, to the extent permitted by such party, technical and material assistance necessary to fulfil such responsibility.

(c) With respect to MOTAPMs, and minefields and mined areas of MOTAPMs, laid by a party in areas over which it no longer exercises control, such party shall provide to the party in control of the area, pursuant to sub-paragraph (b) of this paragraph, to the extent permitted by such party, technical and material assistance necessary to fulfil such responsibility.

9. Information on weapons used during conflict should be made available, in a format that can be readily used, to the party in control of the affected area - or to a mutually agreed third party (such as, inter alia, the United Nations) as an intermediary - so that operators can use the information quickly to protect civilians and humanitarian workers.
