At its sixty-ninth session, the Maritime Safety Committee (MSC) of IMO was invited to consider draft guidelines for the prevention and suppression of unsafe practices associated with the trafficking or transport of migrants by sea proposed by Italy (MSC 69/WP.1; this document revoked MSC 69/21/2).

226. IMO recalled the provisions of IMO Assembly resolution A.867(20), on combating unsafe practices associated with the trafficking or transport of migrants by sea, in which Governments were requested to detain all unsafe ships and report pertinent information to IMO (see A/55/61, para. 109).

94. Prior to the adoption of the Migrants Protocol, IMO approved in 1988 interim, non-binding measures for combating unsafe practices associated with the trafficking or transport of migrants by sea (MSC/CIRC.896/Rev.1).

In resolution A.867(20) on combating unsafe practices associated with the trafficking or transport of migrants by sea, which was adopted by the IMO Assembly at its twentieth session, the Assembly noted with concern the incidents involving the loss of life resulting from the use of substandard ships for the transport of migrants and noted that work was being carried out in this field by the Commission on Crime Prevention and Criminal Justice.

223. The IMO Maritime Safety Committee at its 70th session, in December 1998, approved a circular (MSC/Circ.896) advising Governments what “Interim Measures for Combating Unsafe Practices Associated with the trafficking or transport of migrants by Sea” they could take, pending the entry into force of the convention and protocol referred to above.
٢٢٣ - ووافقت لجنة السلامة البحرية التابعة للمنظمة البحرية الدولية في دورتها ٧٠، المعقودة في كانون اﻷول/ ديسمبر ١٩٩٨، على التعميم (MSC/Circ.896) الذي تنصح فيه الحكومات بما يمكن أن تتخذه من " تدابير مؤقتة لمكافحة الممارسات غير المأمونة المرتبطة بالاتجار بالمهاجرين أو نقلهم عن طريق البحر " ، ريثما يبدأ نفاذ الاتفاقية والبروتوكول المشار إليهما أعلاه.

It has been signed so far by 97 States and ratified by 5.36 Its provisions are based to a great extent on the 1988 United Nations Convention against the Illicit Traffic in Narcotic Drugs and Psychotropic Substances, UNCLOS and the IMO Interim Measures for Combating Unsafe Practices Associated with the trafficking or transport of migrants by Sea, adopted in 1998 and revised in 2001 (for a more detailed description, see A/56/58, para. 228).
