٣ - تطلب الى الدول أن تنظر في اعتماد أية تدابير تشريعية أو غيرها من التدابير التي قد تقتضيها الضرورة لتجريم صنع اﻷسلحة النارية وأجزائها ومكوناتها والذخائر وكذلك المتفجرات والاتجار بها بصورة غير مشروعة ، بموجب قوانينها الوطنية ؛

Of the responding States, 4511 reported that their legislation permitted such shifting of the burden of proof, and 47 reported that this was not permitted under their domestic law.

[4. States Parties shall execute requests for assistance in the recovery of illicitly acquired assets pursuant to this article as a fundamental purpose of this Convention and to the full extent possible under their domestic law.]

130. The Security Council, in its resolution 827 (1993) of 25 May 1993, stipulated that " all States shall cooperate fully " with the Tribunal and its organs and " shall take any measures necessary under their domestic law to implement the provisions " of the statute and comply with " requests for assistance or orders issued by a Trial Chamber " (para. 4).
١٣٠ - قضى مجلس اﻷمن في قراره ٨٢٧ )١٩٩٣( المؤرخ ٢٥ أيار/مايو ١٩٩٣، بأن " تتعاون جميع الدول تعاونا تاما " مع المحكمة الدولية وأجهزتها، وأن تتخذ أية تدابير لازمة في إطار قانونها الداخلي لتنفيذ أحكــــام " النظام اﻷساسي، وتمتثل " لطلبات المساعدة أو اﻷوامر الصادرة عن إحدى دوائر المحاكمة " )الفقرة ٤(.

The Commission recommends that consideration be given to requesting the States producing arms and matériel to take any measure necessary under their domestic law to implement the provisions of resolutions 918 (1994) of 17 May 1994, 997 (1995) of 9 June 1995 and 1011 (1995) of 16 August 1995 and, in particular, to prosecute their nationals for violations of the arms embargo imposed by the said resolutions.
