The internment of prisoners of war and civilians in international armed conflict was regulated by the Third and Fourth Geneva Conventions.

The Geneva Conventions of 1949 and the additional protocols thereto contain provisions by which States guarantee security and life and respect for and protection of personal rights and religious beliefs of prisoners of war and civilians falling under the power of an adverse party.

13. Requests the Secretary-General to continue to investigate fully reports about mass killings of prisoners of war and civilians and incidents of rape in Afghanistan and to include his findings in his next report to be submitted pursuant to paragraph 19 below;
١٣ - تطلب إلى اﻷمين العام أن يواصل التحقيق الكامل في التقارير المتعلقة بوقوع عمليات قتل جماعي ﻷسرى الحرب والمدنيين وحوادث اغتصاب في أفغانستان، وأن يضمﱢن تقريره القادم، الذي سيقدم عملا بالفقرة ١٩ أدناه، ماسينتهي إليه من نتائج؛

(a) The Secretary-General to continue to investigate fully reports of mass killings of prisoners of war and civilians and cases of rape in Afghanistan, and requests all Afghan parties to cooperate with such investigation;
)أ( اﻷمين العام على مواصلة التحقيق تحقيقاً كاملاً في التقارير الواردة عن القتل الجماعي ﻷسرى الحرب والمدنيين وحالات الاغتصاب في أفغانستان، وتطلب إلى كافة اﻷطراف اﻷفغانية التعاون في هذا التحقيق؛

“The Council supports the steps of the Secretary-General to launch investigations into alleged mass killings of prisoners of war and civilians in Afghanistan, the outcome of which will be submitted to the General Assembly and the Security Council as soon as it becomes available.
" ويؤيد المجلس الخطوات التي اتخذها اﻷمين العام للبدء في تحقيقات بشأن مزاعم بحالات قتل جماعي ﻷسرى الحرب والمدنيين في أفغانستان، والتي سوف تقدم نتائجها إلى الجمعية العامة والمجلس حالما تتوفر.

(g) Request the Secretary-General to continue to investigate fully reports about mass killings of prisoners of war and civilians and incidents of rape in Afghanistan and to include his findings in his next report to be submitted pursuant to paragraph 19 of the resolution.

" ويؤيد المجلس خطوات اﻷمين العام الرامية إلى بــدء تحقيقــات فــي الادعاءات التي تفيد بوقوع عمليات قتل جماعي ﻷســرى الحرب والمدنيين في أفغانستان، على أن تعــرض نتائجها على الجمعية العامة وعلى مجلس اﻷمن فور توافرها.

The Protocol additional to the Geneva Conventions of 12 August 1949, and relating to the protection of victims of international armed conflicts, also provides for the protection of prisoners of war and civilians detained or interned in relation to armed conflict.
وبدوره ينص البروتوكول الإضافي إلى اتفاقيات جنيف المعقودة في 12 آب/أغسطس 1949 والمتعلق بحماية ضحايا المنازعات الدولية المسلحة على حماية أسرى الحرب والمدنيين المحتجزين أو المعتقلين في سياق النزاع المسلح.

13. Requests the Secretary-General to continue investigations into alleged mass killings of prisoners of war and civilians as well as ethnically-based forced displacement of large groups of the population and other forms of mass persecution in Afghanistan, and to submit the reports to the General Assembly and the Security Council as soon as they become available;
١٣ - يطلب إلى اﻷمين العام أن يواصــل التحقيقــات في الادعــاءات المتعلقة بوقوع عمليات قتـــل جماعــي ﻷســرى الحرب والمدنيين وكذلــك التشريــد القســري القائم على اﻷصل اﻹثني لجماعـــات كبيــرة من السكان واﻷشكال اﻷخرى للاضطهاد الجماعي في أفغانستـــان، وأن يقــدم التقاريــر إلى الجمعية العامة ومجلس اﻷمن حال توفرها؛

For example, while protection may refer in refugee law, inter alia, to facilitating voluntary repatriation or assimilation, the institution of asylum, and the principle of non-refoulement, it involves different issues in international humanitarian law, such as, inter alia, granting ICRC access to prisoners of war and civilians deprived of their liberty, providing relief to victims of war and appointing protecting powers.

Moreover, article 12 of the Geneva Convention relative to the Treatment of Prisoners of War (Third Geneva Convention) and article 45 of the Fourth Geneva Convention provide that prisoners of war and civilians " may only be transferred by the Detaining Power to a Power which is a party to the Convention and after the Detaining Power has satisfied itself of the willingness and ability of such transferee Power to apply the Convention " .
