3. In respect of the paragraph 5, second sentence concerning the providing of universal jurisdiction “over gross violations of human rights and international humanitarian law which constitute crimes under international law”, the Republic of Croatia is of the opinion that such provision contains somewhat unclear reference to the character of the crimes over which universal jurisdiction is to be applied.
٣- وفيما يتعلق بالفقرة ٥، وفي الجملة الثانية التي تتناول اتاحة الاختصاص القضائي العالمي في حالة " الانتهاكات الجسيمة لحقوق الانسان وقواعد القانون الانساني الدولي " التي تشكل جرائم بموجب القانون الدولي، ترى جمهورية كرواتيا أن هذا النص يتضمن اشارة غير واضحة الى حد ما الى طابع الجرائم التي ينطبق عليها الاختصاص القضائي العالمي.

46. Article 5 of the Constitution, referred to above, reflects Basic Principle IV, which is contained in the annex to resolution 60/147, which states that " statutes of limitations shall not apply to gross violations of international human rights law and serious violations of international humanitarian law which constitute crimes under international law " .
46 - وتعكس المادة 5 من الدستور، المشار إليها أعلاه، المبدأ التوجيهيَ الرابع الوارد في مرفق القرار 60/147، الذي ينص على أنه " لا تنطبق قوانين التقادم على الانتهاكات الجسيمة للقانون الدولي لحقوق الإنسان والانتهاكات الخطيرة للقانون الإنساني الدولي التي تشكل جرائم بموجب القانون الدولي " .

4. In order to clarify the scope of the above—mentioned provision calling for the establishment of universal jurisdiction over gross violations of human rights, the Republic of Croatia proposes that such provision should refer to “gross violations of human rights which constitute crimes under international law and grave breaches of the Geneva Conventions of 1949 and Additional Protocol I of 1977”.
٤- وبغية توضيح نطاق الحكم المشار اليه أعلاه والذي يطالب بتطبيق الاختصاص القضائي العالمي على الانتهاكات الجسيمة لحقوق الانسان، تقترح حكومة كرواتيا أن يشير ذلك الحكم الى " الانتهاكات الجسيمة لحقوق الانسان، التي تشكل جرائم بموجب القانون الدولي وإخلالاً خطيراً باتفاقيات جنيف لعام ١٩٤٩ وبالبروتوكول اﻹضافي اﻷول لعام ١٩٧٧ " .
