Article 9. Extradition of persons who have committed a crime

Thus, pursuant to article 16 of the Penal Code of the Republic of Tajikistan, the extradition of persons who have committed a crime takes place in the following cases:

1. Citizens of Turkmenistan who have committed a crime in the territory of a foreign State shall not be subject to extradition to that State.

Pursuant to article 8 of the Criminal Code of Ukraine, the application of the law extends to foreigners and stateless persons not permanently resident in Ukraine who have committed a crime beyond its borders.

Article 9 of the Criminal Code of Turkmenistan, on the extradition of persons who have committed a crime, provides that:

1. Citizens of Turkmenistan who have committed a crime in the territory of a foreign State shall not be subject to extradition to that State.

At the same time, part two, article 16, of the Penal Code provides that foreign nationals and stateless persons who have committed a crime outside the Republic of Tajikistan and are present in its territory may be extradited to a foreign State for the purposes of criminal prosecution or to serve a sentence in accordance with an inter-State treaty.

However, refugee status is denied to persons who have committed a crime against peace, a war crime or a crime against humanity, including one of a terrorist nature, or to persons guilty of acts which run counter to the aims and principles of the United Nations.

In accordance with Article 15 of the Criminal Code, the citizens of the Republic of Armenia, as well as permanent residents, and stateless persons who have committed a crime outside the Republic of Armenia, are subject to criminal liability if the act committed by them is recognized as a crime by the legislation of the state, where it was committed and if they have not been convicted for the same crime in another state.

The assignment includes the issue of an alternative procedure for people who have committed a crime and who have a developmental disability, autism or similar conditions, or a brain injury that has been sustained in adult life.

2 - يجوز تسليم المواطنين الأجانب والأشخاص عديمي الجنسية الذين ارتكبوا جريمة خارج جمهورية طاجيكستان والموجودين في إقليمها إلى دولة أجنبية لمقاضاتهم جنائيا أو لقضاء مدة عقوبة وفقا لأحكام معاهدة بين الدولتين.

Article 13, paragraph 1, of the Russian Criminal Code also provides that " Russian nationals who have committed a crime in the territory of a foreign State shall not be subject to extradition to that State " .
وتنص الفقرة 1 من المادة 13 في القانون الجنائي الروسي أيضا على أن " المواطنين الروس الذين ارتكبوا جريمة في إقليم دولة أجنبية لا يكونون عرضة للتسليم إلى تلك الدولة " .

26. Foreign nationals and stateless persons who have committed a crime outside Turkmenistan and who are in its territory may be extradited to a foreign State for criminal prosecution or to serve a sentence, in accordance with the international treaties and agreements to which Turkmenistan is a party.

(3) Persons who have committed a crime against humanity;

While the Committee notes that legislation in the State party allows for the prosecution of nationals who have committed a crime abroad, it regrets that the State party has not established extraterritorial jurisdiction in all cases that are referred to in article 4 of the Optional Protocol.
21- تلاحظ اللجنة أن التشريعات في الدولة الطرف تجيز محاكمة المواطنين الذين ارتكبوا جرائم في الخارج، غير أنها تأسف لعدم إنشاء الدولة الطرف ولاية قضائية خارج حدودها الإقليمية في جميع الحالات المشار إليها في المادة 4 من البروتوكول الاختياري.

511. Pursuant to article 14, paragraph 2, of the Criminal Code, persons who have committed a crime are equal before the law, regardless of origin, social, official or material status, gender or other circumstances.

This situation makes it impossible for persons who have committed a crime in the territory of another State to go into hiding in the territory of the Republic of Tajikistan.

Accordingly, article 9 of the Criminal Code of Turkmenistan, approved on 12 June 1997, provides that citizens of Turkmenistan who have committed a crime in the territory of a foreign State are not subject to extradition to that State.
