When the alleged offender is present in any territory under the State party's jurisdiction, the State has an obligation to either extradite or surrender the individual to another State or to an international criminal tribunal whose jurisdiction it has recognized.

2. Each State Party shall likewise take such measures as may be necessary to establish its jurisdiction over the offence of enforced disappearance when the alleged offender is present in any territory under its jurisdiction, unless it extradites or transfers him or her to another State in accordance with its international obligations or transfers him or her to an international criminal tribunal whose jurisdiction it has recognized.

1. The State Party in the territory under whose jurisdiction a person alleged to have committed an offence of enforced disappearance is found shall, if it does not extradite that person or transfer him or her in accordance with its international obligations to another State or transfer him or her to an international criminal tribunal whose jurisdiction it has recognized, submit the case to its competent authorities for the purpose of prosecution.
1- على الدولة الطرف التي يُعثر في إقليم خاضع لولايتها القضائية على المرتكب المفترض لجريمة اختفاء قسري، أن تحيل القضية إلى سلطاتها المختصة لمباشرة الدعوى الجنائية، إن لم تسلم الشخص المعني أو لم تحله، وفقاً لالتزاماتها الدولية إلى دولة أخرى، أو لم تحله إلى محكمة جنائية دولية تعترف باختصاصها.

On one occasion, the " third alternative " is contemplated in this context, by it being provided that this basis of universal jurisdiction shall apply unless the State " extradites or surrenders [the alleged offender] to another State in accordance with its international obligations or surrenders him or her to an international criminal tribunal whose jurisdiction it has recognized " (emphasis added).
