194- وأُعرب عن رأي مفاده أنه لا ينبغي للدول القادرة على تطوير قدراتها الفضائية من دون ضوابط، مما يفضي إلى ما يواجَه حاليا من تحديات، أن تستخدم هذا البند كذريعة لكي تقيّد حرية الدول الراغبة في ممارسة حقها المشروع في استخدام التكنولوجيا نفسها لمنفعتها الوطنية، أو لكي تفرض ضوابط على تلك الدول.

208- وأعربت بعض الوفود عن رأي مفاده أنَّ النظر في مسألة استدامة أنشطة الفضاء الخارجي في الأمد البعيد لا ينبغي أن يفضي إلى أي صك يمكن للدول التي تمكنت من تطوير قدرات فضائية أن تتخذه ذريعة لفرض قيود أو ضوابط على الدول الأخرى الراغبة في ممارسة حقها المشروع في استخدام تكنولوجيا الفضاء في الحصول على منافع مجتمعية.

13. More complex matters should now be addressed, such as the kinds of crimes that entailed the exercise of universal jurisdiction, its subsidiary character in relation to the principles of territoriality and personality and whether the State where the crime took place needed to give formal consent and the alleged criminal had to be present in the territory of the State wishing to exercise universal jurisdiction for the purpose of prosecution.

155- ورأى بعض الوفود أنه لا ينبغي للدول، التي استطاعت تطوير قدراتها الفضائية دون ضوابط، مع ما نجم عن ذلك من التحديات الماثلة اليوم، أن تتخذ من مراعاة استدامة الأنشطة الفضائية في الأمد البعيد ذريعة لكي تقيّد حرية الدول الأخرى الراغبة في ممارسة حقها المشروع في استخدام التكنولوجيا نفسها لمنفعتها الوطنية، أو لكي تفرض ضوابط على تلك الدول.

At the appropriate time, the questions of whether there was a need for the formal consent of the State where the crime took place or the presence of the alleged perpetrator in the territory of the State wishing to exercise jurisdiction should be considered. It would also be advisable to avoid prosecution in multiple forums, which could violate the rights of the accused.
وينبغي أن يتم في الوقت المناسب النظر في المسائل المتعلقة بما إذا كان ثمة حاجة لموافقة رسمية من الدولة التي ارتكبت على أرضها الجريمة أو لوجود الجاني المتهم على أرض الدولة التي ترغب في ممارسة الولاية القضائية، فإن هذا أمر ينبغي النظر فيه لسوف يكون مستصوباً تجنُّب المقاضاة في مواقع متعددة مما يمكن أن ينتهك حقوق المتهم.

Some delegations expressed the view that the recommendations and guidelines of the Working Group should not limit access to outer space by developing countries with emerging space capabilities wishing to exercise their legitimate right to use space technology for societal benefit and that States had to ensure that outer space was not used to favour commercial interests that undermined the social interests of humanity.
202- ورأت بعض الوفود أنَّ توصيات الفريق العامل ومبادئه التوجيهية لا ينبغي أن تحدَّ من فرص الاستفادة من الفضاء الخارجي أمام البلدان النامية ذات القدرات الفضائية الناشئة التي ترغب في ممارسة حقها المشروع في استخدام تكنولوجيا الفضاء في الحصول على منافع مجتمعية وأنَّ على الدول أن تكفل عدم استخدام الفضاء الخارجي لتعزيز مصالح تجارية من شأنها أن تقوِّض المصالح الاجتماعية للإنسانية.
