UNDER ARTICLE 40 OF THE COVENANT Under article 2, paragraph 1, of the International Covenant on Civil and Political Rights, each State party undertakes to respect and to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized in the Covenant.
55- تتعهد كل دولة طرف، بموجب الفقرة 1 من المادة 2 من العهد الدولي الخاص بالحقوق المدنية والسياسية، باحترام الحقوق المعترف بها في العهد وكفالة هذه الحقوق لجميع الأفراد المقيمين داخل أراضيها والخاضعين لولايتها.

(a) To abide by its freely undertaken obligations under international human rights treaties and international humanitarian law and to respect and ensure the rights of all individuals, irrespective of their origin, ethnicity, gender or religion, within its territory and subject to its jurisdiction;
(أ) أن تفي بالتزاماتها التي تعهدت بها بحرية بموجب المعاهدات الدولية المتعلقة بحقوق الإنسان والقانون الإنساني الدولي، وأن تحترم وتكفل حقوق جميع الأفراد الموجودين داخل أراضيها والخاضعين لولايتها، بصرف النظر عن أصلهم أو انتمائهم العرقي أو جنسهم أو دينهم؛

2. Calls upon the Government of Iraq to abide by its freely undertaken obligations under international human rights treaties and international humanitarian law and to respect and ensure the rights of all individuals, irrespective of their origin, ethnicity, gender or religion, within its territory and subject to its jurisdiction;
٢ - تطلب إلى حكومة العراق أن تفي بالتزاماتها التي تعهدت بها بحرية بموجب المعاهدات الدولية لحقوق اﻹنسان والقانون اﻹنساني الدولي، وأن تحترم وتكفل حقوق جميع اﻷفراد الموجودين داخل أراضي العراق والخاضعين لولايته، وذلك بصرف النظر عن أصلهم أو انتمائهم العرقي أو جنسهم أو دينهم؛

On the other hand, article 2, paragraph 1, of the Covenant requires that each State party to the Covenant undertakes to respect and to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized in the present Covenant, without distinction of any kind.

On the other hand, article 2, paragraph 1, of the Covenant requires that each State Party to the Covenant undertakes to respect and to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized in the present Covenant, without distinction of any kind.

While welcoming the abundance of laws and tables submitted for examination, the Committee noted that the report and the delegation did not sufficiently explain how Covenant rights are enjoyed in practice by the generality of the people within its territory and subject to its jurisdiction.
وإذ ترحب اللجنة بوفرة القوانين والجداول المقدمة إليها لدراستها، فقد لاحظت أن التقرير والوفد لم يشرحا شرحاً كافياً كيفية تمتع عامة الناس المتواجدين داخل أراضي البلد والخاضعين لولايته تمتعاً عملياً بالحقوق المنصوص عليها في العهد.

The Committee welcomes the accession of the State party to the Optional Protocol to the Covenant in 1991, thereby recognizing the competence of the Committee to consider communications from individuals within its territory and subject to its jurisdiction.
502- ترحب اللجنة بانضمام الدولة الطرف إلى البروتوكول الاختياري للعهد في عام 1991 الذي يقر بصلاحية اللجنة في النظر في البلاغات الواردة من الأفراد داخل إقليم الدولة والخاضعين لولايتها القضائية.

Accordingly, they urged the Government of the Islamic Republic of Iran to abide by its obligations under the international human rights instruments and to ensure that all individuals within its territory and subject to its jurisdiction enjoyed the rights recognized in those instruments.

It provides that a State party has the obligation to respect and to ensure the rights recognized in the Covenant for all individuals within its territory and subject to its jurisdiction.
وتنص على أن الدولة الطرف ملزمة باحترام وكفالة الحقوق المعترف بها في العهد لجميع الأفراد الموجودين في أراضيها والخاضعين لولايتها.

Relevant for the consideration of this issue is the State party's obligation, under article 2, paragraph 1, of the Covenant, to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized in the Covenant.
وما يتصل بالنظر في هذه القضية هو التزام الدولة الطرف بموجب الفقرة ١ من المادة ٢ من العهد بأن تكفل لجميع اﻷشخاص على أراضيها والخاضعين لولايتها الحقوق المسلم بها في العهد.

Under article 2 of the Covenant the State party is also obliged to ensure that any person within its territory and subject to its jurisdiction has an effective remedy if his or her rights under the Covenant are violated.
