وإذ تؤكد أن العنف ضد المرأة ينتهك ويعوق أو يلغي تمتع المرأة بحقوق اﻹنسان وحرياته اﻷساسية، وإذ يقلقها اﻹخفاق، منذ أمد بعيد، في حماية وتعزيز تلك الحقوق والحريات فيما يتصل بالعنف ضد المرأة،

3. Further expresses its concern at the widespread discrimination against women in the Islamic Republic of Iran and the lack of full and equal enjoyment by women of human rights, and calls upon the Government of the Islamic Republic of Iran to take effective measures to eliminate all discrimination against women;
٣ - تعرب عن قلقها كذلك إزاء التمييز الذي تتعرض له المرأة على نطاق واسع في جمهورية إيران اﻹسلامية، وعدم تمتع المرأة بحقوق اﻹنسان على نحو كامل ومتكافئ، وتطلب إلى حكومة جمهورية إيران اﻹسلامية أن تتخذ تدابير فعالة للقضاء على جميع أشكال التمييز ضد المرأة؛

Consequently claims of titles to nobility are not compatible with the provisions of the Convention as denial of such claims do not nullify or impair the exercise by women of human rights and fundamental freedoms.
وبالتالي فإنّ المطالبات بألقاب النبالة تتعارض وأحكام الاتفاقية لأنّ إنكار مثل هذه المطالبات لا يُبطل ممارسة المرأة حقوق الإنسان والحريات الأساسية أو ينال منها.

Consequently claims of titles to nobility are not compatible with the provisions of the Convention as denial of such claims do not nullify or impair the exercise by women of human rights and fundamental freedoms.
ومن ثم، تتعارض المطالبات بألقاب النبالة مع أحكام الاتفاقية حيث أن رفض هذه المطالبات لا يبطل أو يضعف ممارسة المرأة لحقوق الإنسان والحريات الأساسية.

Consequently, we consider that claims of succession to such titles of nobility are not compatible with the provisions of the Convention, which are aimed at protecting women from discrimination which has the effect or purpose of impairing or nullifying the recognition, enjoyment or exercise by women on a basis of equality of men and women, of human rights and fundamental freedoms in all fields.
ومن ثم، نرى أن مزاعم الأحقية في وراثة ألقاب النبالة لا تتفق مع أحكام الاتفاقية، التي ترمي إلى حماية المرأة من التمييز الذي يكون من أثره أو أغراضه إضعاف أو إبطال الاعتراف للمرأة بحقوق الإنسان والحريات الأساسية في الميادين كافة، أو إضعاف أو إبطال تمتعها بهذه الحقوق أو ممارستها لها.

" 3. 4. Expresses its concern at the lack of full and equal enjoyment by women of human rights, and calls upon the Government of the Islamic Republic of Iran to take effective measures to eliminate discrimination against women;
٤- تعرب عن قلقها إزاء عدم تمتع المرأة بحقوق اﻹنسان تمتعاً كاملاً ومتساويا، وتطالب حكومة جمهورية إيران اﻹسلامية باتخاذ تدابير فعالة للقضاء على التمييز ضد المرأة؛

Recalling General Assembly resolution 48/104 of 20 December 1993, proclaiming the Declaration on the Elimination of Violence against Women, in which the Assembly recognized that violence against women violated and impaired or nullified the enjoyment by women of human rights and fundamental freedoms,
وإذ تشير إلى قرار الجمعية العامة ٨٤/٤٠١ المؤرخ ٠٢ كانون اﻷول/ديسمبر ٣٩٩١، الذي يتضمن إعلان القضاء على العنف ضد المرأة، والذي أقرت الجمعية فيه بأن العنف ضد المرأة يُخِلﱡ بتمتع المرأة بحقوق اﻹنسان والحريات اﻷساسية ويعَوﱢق أو يلغي تمتعها بهذه الحقوق والحريات،

7. Gender-based violence, which impairs or nullifies the enjoyment by women of human rights and fundamental freedoms under general international law or under human rights conventions, is discrimination within the meaning of article 1 of the Convention.
٧- والعنف القائم على أساس الجنس الذي ينال من تمتع المرأة بحقوق اﻹنسان والحريات اﻷساسية بموجب القانون الدولي العمومي أو بمقتضى اتفاقيات محددة لحقوق اﻹنسان، أو يبطل تمتعها بتلك الحقوق والحريات، يعتبر تمييزا في إطار معنى المادة ١ من الاتفاقية.

(f) At the lack of full and equal enjoyment by women of human rights, while noting efforts to integrate women more fully into the political, economic and cultural life of the country;

A textual reading of article 1 of the Convention as seen in the concurring opinion, stating that claims of titles to nobility are not compatible with the provisions of the Convention as denial of such claims do not nullify or impair the exercise by women of human rights and fundamental freedoms, does not take into account the intent and spirit of the Convention.
أمّا القراءة الحرفية للمادة 1 من الاتفاقية على النحو الوارد في الرأي المماثل، التي تفيد بأنّ المطالبات بألقاب النبالة لا تتماشى وأحكام الاتفاقية لأنّ إنكار مثل هذه المطالبات لا يُبطل ممارسة المرأة حقوق الإنسان والحريات الأساسية أو ينال منها، فإنها لا تأخذ في الاعتبار روح الاتفاقية والقصد منها.

ومن ثم، نرى أن مزاعم الأحقية في وراثة ألقاب النبالة لا تتفق مع أحكام الاتفاقية، التي ترمي إلى حماية المرأة من التمييز الذي يكون من أثره أو أغراضه إضعاف أو إبطال الاعتراف للمرأة بحقوق الإنسان والحريات الأساسية في كافة الميادين، أو إضعاف أو إبطال تمتعها بهذه الحقوق أو ممارستها لها.
