At its twenty-second session, the Working Group on Insolvency Law considered the feasibility of the Commission undertaking further work on insolvency law.

9. During the present year's sessions, the Working Group on Insolvency Law had concluded its work on the draft Legislative Guide on Insolvency Law, which was expected to be useful to many States in developing their legislation.

69. His delegation also noted the work of the Working Group on Security Interests in preparing the draft legislative guide on secured transactions, and looked forward to future work of the Working Group on Insolvency Law, now that the UNCITRAL Legislative Guide on Insolvency Law had been concluded.

The Working Group on Insolvency Law commenced the preparation of a legislative guide to insolvency law at its twenty-fourth session (New York, 23 July to 3 August 2001) and continued its work at its twenty-fifth session (Vienna, 3-14 December 2001).

The Commission had given the Working Group on Insolvency Law the mandate to prepare a comprehensive statement of key objectives and core features for a strong insolvency regime, including consideration of out-of-court restructuring and a legislative guide containing flexible approaches to the implementation of such objectives and features.

The twenty-fourth session of the Working Group on Insolvency Law (New York, 23 July-3 August 2001) commenced consideration of this work with the first draft of the legislative guide on insolvency law.

Mr. Redmond (Observer for the American Bar Association) said that at an early stage in its work the Working Group on Insolvency Law had established the principles necessary for developing an effective reorganization procedure, which had led to a recognition that no single procedure could ensure effectiveness, and that an accumulation of proceedings and processes was needed.
