105. In the context of the Secretary-General's study on the question of violence against children and the related questionnaire sent to Governments, the Committee acknowledges with appreciation the written replies of the State party to this questionnaire and its participation in the Pacific regional consultation on violence against children, held in Fiji from 26 to 28 September 2005.

While taking note of information provided by the delegation that public spending on the health sector will increase, the Committee is concerned that health care may not be a Government priority and that recent activities reported on in the written replies of the State party have been developed and implemented almost exclusively by the National Council for Childhood and Motherhood.

The consequence of such a decision was to deprive some members of the Committee of the information contained in the written replies of States parties, which ran counter to the principle of equality between Committee members and had a discriminatory effect, in violation not only of the basic right of every individual, but also of the Committee's rules of procedure.

Sir Nigel RODLEY said that, while he welcomed the comprehensive overview contained in the State party's written replies of the evolution of legislation to counter domestic violence, in the absence of specific information on action taken in relation to such acts it was difficult to see how those provisions were implemented in practice.

11. Mr. Matadeen said that the written replies of the State party concerning the right to life and the prohibition of torture and cruel, inhuman or degrading treatment, liberty and security of person, and the treatment of persons deprived of liberty were very brief and that it denied all the Committee's allegations.

Over and above the explanation given in the written replies of the relationship between the Gender Equality and Equal Treatment Commissioner and the Chancellor of Justice, she wished to know how each of the two institutions exercised its authority when discrimination stemmed from the law itself or was perpetrated by a State agency.

4. Mr. Hachi (Djibouti), summarizing the written replies of Djibouti to the list of issues prepared by the Committee, said that all Acts emanating from the State's various branches should comply with the Constitution and the provisions of the instruments ratified by the country, including the Covenant.
