It recommended acceding to the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (OP-CAT) and establishing the required national preventive mechanism.
وأوصت بالانضمام إلى البروتوكول الاختياري لاتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، وإنشاء الآلية الوقائية الوطنية المطلوبة.

1. Constitutional protection of human rights, including the prohibition of Torture and Other Cruel, inhuman or degrading treatment or punishment

The access of CNDH to places of detention and the post-visit report, as well as the work to ratify the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, are important steps towards establishing an effective monitoring mechanism in Morocco.
ودخول المجلس الوطني لحقوق الإنسان إلى أماكن الاحتجاز والتقرير الذي يعقب الزيارة، فضلاً عن العمل المضطلع به بهدف التصديق على البروتوكول الاختياري لاتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، خطوات هامة تهدف كلها إلى وضع آلية رصد فعالة في المغرب.

6. Ratification of the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment

El 14 de abril de 1997, la Asociación Nacional de Derechos Humanos publicó y presentó al Comité contra la Tortura de las Naciones Unidas el Shadow Report: Status of the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment in the Republic of Namibia.
في 14 نيسان/أبريل 1997، نشرت الجمعية الوطنية لحقوق الإنسان وقدمت إلى لجنة الأمم المتحدة لمناهضة التعذيب تقريرها المعنون: تقرير الظل: حالة اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة اللاإنسانية أو المهينة في جمهورية ناميبيا.

12. Saudi Arabia has ratified the Convention on the Rights of the Child, the International Convention for the Elimination of All Forms of Racial Discrimination, the Convention on the Elimination of All Forms of Discrimination against Women and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.
12- وقد صدقت السعودية على اتفاقية حقوق الطفل، والاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري، واتفاقية القضاء على جميع أشكال التمييز ضد المرأة، واتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة.

96. The Special Rapporteur welcomes the issuance of the Law on Criminal Procedure and particularly the inclusion of provisions prohibiting Torture and Other Cruel, inhuman or degrading treatment, and guaranteeing the right to have access to a lawyer at all stages of the legal process.
96- ويرحب المقرر الخاص بإصدار نظام الإجراءات الجزائية، لا سيما بإدراج أحكام تحظر التعذيب وغيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة، وتضمن الحق في الاتصال بمحامٍ في جميع مراحل الإجراءات القانونية.

1. The Special Rapporteur of the United Nations Commission on Human Rights on Torture and Other Cruel, inhuman or degrading treatment or punishment, Mr. Manfred Nowak, undertook a visit to Jordan from 25 to 29 June 2006, at the invitation of the Government.
مقدمة 1- قام السيد مانفرد نوفاك، المقرر الخاص للجنة حقوق الإنسان المعني بمسألة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، بزيارة الأردن في الفترة من 25 إلى 29 حزيران/يونيه 2006 بناءً على دعوة من الحكومة.

9. The Special Rapporteur notes that Jordan is a State party to the major United Nations human rights treaties prohibiting torture and ill-treatment, including the International Covenant on Civil and Political Rights (ICCPR); the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and the Convention on the Rights of the Child (CRC).
9- يلاحظ المقرر الخاص أن الأردن دولة طرف في معاهدات الأمم المتحدة الرئيسية لحقوق الإنسان التي تحظر التعذيب وإساءة المعاملة، ومن بينها العهد الدولي الخاص بالحقوق المدنية والسياسية؛ واتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة؛ واتفاقية حقوق الطفل.

Ratify the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and establish a national preventive mechanism with a mandate to undertake unannounced visits to all places where migrants are deprived of their liberty.
86- التصديق على البروتوكول الاختياري لاتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، وإنشاء آلية وقائية وطنية تشمل ولايتها إجراء زيارات مفاجئة إلى جميع المراكز التي يُحرم فيها المهاجرون من حريتهم.

The Government immediately replied to the request from Mr. Manfred Nowak, the Special Rapporteur on the question of Torture and Other Cruel, inhuman or degrading treatment or punishment* to visit Jordan, because it is convinced of the importance of human rights issues and of the need to strengthen cooperation with the United Nations and different international human rights institutions in order to protect and promote human rights.
جاءت الاستجابة الفورية للحكومة لطلب السيد مانفريد نوفاك المقرر الخاص المعني بمسألة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة المتعلق بزيارة الأردن انطلاقاً من قناعة الحكومة بأهمية قضايا حقوق الإنسان وتفعيلاً لدور التعاون مع الأمم المتحدة والمؤسسات الدولية المختلفة العاملة في مجال حقوق الإنسان في سبيل حماية حقوق الإنسان وتعزيزها.

Iraq has also ratified the four Geneva Conventions of 1949, and has signed into law the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, although the process of accession has not been finalized.
وصدق العراق أيضاً على اتفاقيات جنيف الأربع لعام 1949، ووقع اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، جاعلاً إياها جزءاً من القانون، على الرغم من عدم استكمال عملية الانضمام إلى هذه الاتفاقية().

He acknowledges that the definition contained in article 231-1 of the Criminal Code encompasses the main elements of article 1 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, but notes that it does not cover complicity or explicit or tacit consent on the part of law enforcement or security personnel or any other person acting in an official capacity.

(b) Amend article 224 of the Criminal Code to bring the definition of public official into line with the definition of a public servant or other person acting in an official capacity contained in the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment;
(ب) تعديل المادة 224 من القانون الجنائي بحيث يتوافق تعريف الموظف العمومي مع تعريف موظف الخدمة المدنية أو غيره من الأشخاص الذين يعملون بصفة رسمية، الوارد في اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة؛

(d) The entire region would benefit from a robust regional inter-governmental human rights monitoring mechanism as an important confidence-building measure which can help to improve the situation with respect to human rights observance and particularly with respect to the prohibition on Torture and Other Cruel, inhuman and degrading treatment or punishment.
(د) من شأن المنطقة بكاملها أن تستفيد من إنشاء آلية حكومية دولية إقليمية متينة لحقوق الإنسان بوصفها إجراء مهماً لبناء الثقة قد يساعد على تحسين وضع التقيد بحقوق الإنسان، خاصة ما يتعلق بحظر التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة.
