The employers purportedly flout the law by using their domestic workers instead of other workers who have comparatively more rights and protection under the Labour Law.

The Special Rapporteur is therefore encouraged to note that the Ministry, in collaboration with the United Nations, hosted a workshop in November 2005, in which measures to protect domestic workers under the Labour Law were discussed.

Similarly, in Oman, article 20 of the Labour Law provides that if the employer may prove that the employee has not satisfied the conditions provided for in the contract, the employer may return the employee back to the place from which he/she was brought.
وتلك هي الحال أيضاً في عُمان حيث تنص المادة 20 من قانون العمل على أنه يجوز لصاحب العمل أن يعيد المستخدَم من حيث جيء به إذا استطاع أن يثبت أن صاحب العمل لم يلبِّ جميع الشروط المنصوص عليها في العقد.

27. Oman's recently amended Labour Law of 2003 also provides a substantive legal framework for the protection of foreign workers'employment, again with the exception of domestic workers.
27- إن قانون العمل العُماني لعام 2003 الذي عُدِّل مؤخراً يشتمل أيضاً على إطار قانوني موضوعي لحماية العمال الأجانب، باستثناء خدم المنازل هنا أيضاً.

41. Monitoring of compliance with these provisions is foreseen in Part 15 of the Labour Law, which provides work inspectors with extensive powers to enter places of work during working hours, day and night, without prior notification, to inspect registers, books, files or any other documents related to the workers, with a view to ensuring compliance with the law.
41- ويُتوخى رصد مدى الامتثال لهذه الأحكام في الجزء 15 من قانون العمل الذي يمنح مفتشي العمل صلاحيات واسعة لدخول أماكن العمل خلال ساعات العمل، نهاراً وليلاً، دون إخطار مسبق من أجل تفتيش السجلات والدفاتر والملفات أو أية مستندات أخرى تتصل بالعمال بغية ضمان الامتثال لأحكام القانون.

75. In view of these concerns, the Special Rapporteur welcomes the information that amendments to the Bahrain Labour Law of 1976 will include the category of domestic servants within its purview of protection.

16. The Special Rapporteur is very concerned, however, that certain groups of migrants who are particularly vulnerable to trafficking and exploitation are excluded from the protection of the Labour Law.
