As soon as the Convention against Torture was ratified by the National Assembly, it became part of Jordanian law and acquired the force of law. Therefore, if a case of this kind is brought before a domestic court, the Jordanian court must refer to the definition set out in article 2 of the Convention against Torture.
إن اتفاقية مناهضة التعذيب وبمجرد المصادقة عليها ونشرها في الجريدة الرسمية تصبح جزءاً من النظام القانوني الأردني تكتسب قوة القانون، وعلى ذلك فإنه إذا عرضت مسألة من هذا القبيل على القضاء الوطني، فإن المحاكم الأردنية ملزمة بالرجوع إلى التعريف الوارد في المادة 2 من اتفاقية مناهضة التعذيب.

The Government has asked the competent institutions to explore whether article 208 of the Criminal Code can be amended to increase the penalties for public servants, including by ruling out any statute of limitations on, or general amnesty for, acts of torture, and to verify that the article satisfies the requirements of the definition under article 1 of the Convention against Torture.

47. Moreover, despite Jordan's obligation to prohibit non-refoulement under article 3 of the Convention against Torture, GID has participated in activities that attempt to circumvent this prohibition in the context of global cooperation in counter-terrorism activities.

66. The Special Rapporteur notes that article 208 of the Penal Code is not in line with the definition of torture contained in article 1 of the Convention against Torture, is not treated as a significant crime but rather as a misdemeanour, and is not subject to penalties appropriate to its gravity.
66- ويلاحظ المقرر الخاص أن المادة 208 من قانون العقوبات لا تتوافق مع تعريف التعذيب الوارد في المادة 1 من اتفاقية مناهضة التعذيب، وأن التعذيب لا يُعامل بوصفه جريمة كبيرة بل مجرد جنحة، وأن ممارسي التعذيب لا يخضعون لعقوبات تتناسب مع مدى جسامته.

(c) The crime of torture be defined as a matter of priority in accordance with article 1 of the Convention against Torture, with penalties commensurate with the gravity of torture;

Jordan is not a party to the Optional Protocols to the ICCPR, concerning the right of individual petition and the abolition of the death penalty, nor has it recognized the competence of the Committee against Torture (CAT) to consider complaints from individuals by making the declaration under article 22 of the Convention against Torture.
والأردن ليس طرفاً في البروتوكولين الاختياريين الملحقين بالعهد الدولي الخاص بالحقوق المدنية والسياسية والمتعلقين بالحق في تقديم الالتماسات الفردية وبإلغاء عقوبة الإعدام، كما أن الأردن لم يعترف باختصاص لجنة مناهضة التعذيب في النظر في الشكاوى المقدمة من الأفراد، إذ إنه لم يصدر الإعلان المطلوب بموجب المادة 22 من اتفاقية مناهضة التعذيب.

13. However, the definition contained in article 208 is not consistent with article 1 of the Convention against Torture, and this has been noted with concern by the CAT in its concluding observations of 26 July 1995.
13- إلا أن التعريف الوارد في المادة 208 من قانون العقوبات لا يتوافق مع أحكام المادة 1 من اتفاقية مناهضة التعذيب، وهو ما لاحظته بقلق لجنة مناهضة التعذيب في ملاحظاتها العامة المؤرخة 26 تموز/يوليه 1995().

(p) The declaration be made with respect to article 22 of the Convention against Torture recognizing the competence of the Committee against Torture to receive and consider communications from individuals who claim to be victims of a violation of the provisions of the Convention;
