With regard to the death penalty, the Special Rapporteur pointed out that article 6 of the International Covenant on Civil and Political Rights enjoined State Parties to limit the application of the death penalty to the most serious crimes, and that the Human Rights Committee in one of its General Comments had pointed out that although article 6 did not prohibit the death sentence it certainly pointed in the direction of eventual abolition.

The Special Rapporteur is gravely concerned about information that terrorist suspects subjected to detention by SSI officers are at particular risk of torture and that, according to the Human Rights Committee and the Committee against Torture, " recourse to such practices appears to display a systematic pattern " .

He reiterates, in line with the Human Rights Committee, that the right to a full review of the conviction and sentence by a higher court becomes particularly crucial when convictions may lead to the death penalty, which has indeed been the case in several terrorism trials in Egypt.
ويكرر المقرر الخاص، تمشياً مع رأي اللجنة المعنية بحقوق الإنسان()، أن من الحق في إجراء مراجعة كاملة للإدانة والحكم أمام محكمة أعلى يصبح حاسماً بصورة خاصة إذا كان من الممكن أن تؤدي الإدانة إلى الحكم بالإعدام، وهو ما حدث في الواقع في العديد من محاكمات الإرهاب في مصر.

9. Those same bodies, the Human Rights Committee and the International Court of Justice have also confirmed that human rights, including those enshrined in the International Covenant on Civil and Political Rights, are legally binding upon a State when it acts outside its internationally recognized territory.
