61. In 2009, the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous peoples stated that he will continue to monitor progress towards ensuring that the rights of Awas Tingni to their lands are fully respected by third parties.

In 2005, the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous peoples, together with the Special Rapporteur on contemporary forms of racism, racial discrimination, xenophobia and related intolerance, sent an urgent appeal concerning the plight of the Mayangna indigenous community of Awas Tingni, on the Atlantic coast of Nicaragua.

The recent decision of the Inter-American Court of Human Rights in the case of Mayagna (Sumo) Awas Tingni Community v. Nicaragua was referred to by some delegations in this regard, since it unequivocally affirmed that indigenous peoples have, as a matter of international law, collective rights to lands which they have traditionally owned, or otherwise occupied or used.
وأشارت بعض الوفود بهذا الخصوص إلى القرار الذي أصدرته مؤخراً محكمة البلدان الأمريكية لحقوق الإنسان في قضية " أهالي مايغنا (سومو) آواس تينغني ضد نيكاراغوا " ، ذلك أنه ورد في هذه القضية بشكل لا لبس فيه أن الشعوب الأصلية لها، كمسألة تندرج في صلب القانون الدولي، حقوق جماعية في الأراضي التي كانت تمتلكها أو تحتلها أو تستخدمها بشكل تقليدي.
