301. It goes without saying, however, that such a presumption is not irrefragable either, and that if the declaration is really intended to exclude or modify the legal effect of the provisions of the treaty and not simply to interpret them, then it must be considered to be an impermissible reservation and treated as such.

From this point of view, a State or international organization that has formulated a reservation -- even though it is invalid -- has, in fact, expressed its disagreement with the provision or provisions which the reservation purports to modify or the legal effect of which it purports to exclude.
