198. In case No. 1908/2009 (Ostavari v. Republic of Korea), concerning the deportation of the author to the Islamic Republic of Iran, the Committee observed that the author converted to Christianity and that he was visited during his detention in the Republic of Korea by Iranian officials, whom he informed of his conversion.

The Committee noted the complainant's description of the treatment to which he had been subjected while in detention, because of his activities as a Sikh priest, his political involvement with the Akali Dal party and his leadership role in the local structures of the party.

The author submits that the treatment he suffered during his arrest and in successive places of detention amounts to torture or at least cruel, inhuman or degrading treatment, contrary to articles 7 and 10 of the Covenant.

Since during his arrest the author tried to swallow the money received as bribe, he did not react to the instructions given by police and showed resistance, police officers used force by holding his hands and pressing his cheekbones in order to prevent him from swallowing the money.
وحيث إن صاحب البلاغ حاول أثناء اعتقاله أن يبلع الأوراق المالية التي قبلها كرشوة فإنه لم ينفذ الأوامر التي أصدرها أفراد الشرطة وأظهر مقاومته فاستخدم أفراد الشرطة القوة بإمساك ذراعيه والضغط على العظم الوجني من أجل منعه من بلع الأوراق المالية.
