Its credibility continues to be undermined, not only by those who refuse to join it, but also by its very parties, whether through lack of adherence to its provisions or complacency in striving to achieve its universality.
وما زالت توجد محاولات لتقويض موثوقية المعاهدة ليس فقط من طرف الجهات التي ترفض الانضمام إليها بل ومن جانب الجهات الأطراف فيها أيضاً، وذلك إمَّا نتيجة عدم مراعاة أحكامها أو الاكتفاء في السعي لتحقيق عالميتها.

" A reservation is a provision agreed upon between the parties to a treaty with a view to restricting the application of one or more of its clauses or to clarifying their meaning. "
" التحفظ شرط متفق عليه بين الأطراف في معاهدة يرمي إلى تضييق نطاق تطبيق حكم أو أكثر من أحكامها أو إلى تفسير معناها " ().

Although capacity-building has been addressed by MEAs either through their provisions or resolutions of the conferences of parties (CoPs), their implementation can prove problematic.
٦٢- ولئن كانت مسألة بناء القدرات قد تناولتها الاتفاقات البيئية المتعددة اﻷطراف من خلال أحكامها أو من خلال قرارات مؤتمرات اﻷطراف، فإن تنفيذها يمكن أن يتكشف عن مشاكل.

2. States Parties to the Convention may conclude bilateral or multilateral agreements with one another on the matters dealt with in this Convention, for purposes of supplementing or strengthening its provisions or facilitating the application of the principles embodied in it.
٢- يجوز للدول اﻷطراف أن تبرم فيما بينها اتفاقات ثنائية أو متعددة اﻷطراف بشأن المسائل التي تتناولها هذه الاتفاقية، ﻷغراض استكمال أو تدعيم أحكامها أو تيسير تطبيق المبادىء المجسدة فيها.

2. States Parties to this Convention may conclude bilateral or multilateral agreements with one another on the matters dealt with in this Convention for purposes of supplementing or strengthening its provisions or facilitating the application of the principles embodied in it.
2- يجوز للدول الأطراف في هذه الاتفاقية أن تبرم فيما بينها اتفاقات ثنائية أو متعددة الأطراف بشأن الأمور التي تتناولها هذه الاتفاقية، ولغرض استكمال أو تدعيم أحكامها أو تيسير تطبيق المبادئ المجسدة فيها.

2- يجوز للدول الأطراف في هذه الاتفاقية أن تبرم فيما بينها اتفاقات ثنائية أو متعددة الأطراف بشأن الأمور التي تتناولها هذه الاتفاقية، لغرض استكمال أو تدعيم أحكامها أو تيسير تطبيق المبادئ المجسدة فيها.

The State party believes that when an ordinary meaning is given to article 18 of the Covenant, in light of the object and purpose thereof, nothing therein can be construed as suggesting that any " right to a conscientious objection " is explicit in its provisions or may be derived from it.
وتعتقد الدولة الطرف أنه عندما يُعطى معنى لألفاظ المادة 18 من العهد، في ضوء الموضوع والغرض منها، فإنه لا يوجد فيها ما يمكن أن يُؤَوَّل على أنه يشير إلى أن أي " حق في استنكاف ضميري " ، واضح في أحكامها أو يمكن أن يستمد منها.

2- يجوز للدول الأطراف في هذه الاتفاقية أن تبرم فيما بينها اتفاقات ثنائية أو متعددة الأطراف بشأن الأمور التي تتناولها هذه الاتفاقية، لغرض استكمال أو تدعيم أحكامها أو لصالح تطبيق المبادئ المجسدة فيها تطبيقا أفعل.

35. Section 1.7 of the draft guidelines embodied the Commission's view that since reservations were not the only way in which parties to a treaty could exclude or modify the legal effect of certain of its provisions or of certain aspects of the instrument as a whole, it would be useful to link the definition of reservations and interpretive declarations to that of other procedures with the same objective.
35 - وقال إن الفرع 1-7 من مشروع المبادئ التوجيهية يمثل وجهة نظر لجنة القانون الدولي وهي أنه ما دامت التحفظات ليست هي الوسيلة الوحيدة التي يستطيع بها أطراف المعاهدة استبعاد أو تعديل الأثر القانوني لبعض أحكامها أو لجوانب معينة من الصك في مجموعه فإن من المفيد ربط تعريف التحفظات والإعلانات التفسيرية بتعريف الإجراءات الأخرى التي يكون لها نفس الهدف.

35. Human rights instruments enjoy special status in regard to the application of this principle. Accordingly, such international instruments become binding and enforceable without any need to incorporate their provisions or texts in a corresponding domestic legislative enactment.
٥٣- وتحتل اتفاقيات حقوق اﻹنسان مكاناً خاصاً في مجالات تطبيق هذا المبدأ، واستناداً لذلك، فإن الاتفاقية الدولية تصبح ملزمة ونافذة، دون أن تكون هناك حاجة إلى تضمين أحكامها أو نصوصها في تشريع داخلي مماثل.
