Recognizing the need to elaborate effective international rules and procedures concerning liability for damage caused by space objects and to ensure, in particular, the prompt payment under the terms of this Convention of a full and equitable measure of compensation to victims of such damage,
وإذ تعترف بضرورة وضع قواعد وإجراءات دولية فعالة بشأن المسؤولية عن الأضرار التي تحدثها الأجسام الفضائية، وخاصة ضرورة كفالة دفع تعويض كامل وعادل، بموجب أحكام هذه الاتفاقية لضحايا هذه الأضرار،

Any provision of this Convention that may provide a defence for, or limit the liability of, the carrier applies in any judicial or arbitral proceeding, whether founded in contract, in tort, or otherwise, that is instituted in respect of loss of, damage to, or delay in delivery of goods covered by a contract of carriage or for the breach of any other obligation under this Convention against:
1- أيُّ حكم من أحكام هذه الاتفاقية يمكن أن يوفِّرَ وسيلةَ دفاع للناقل أو أن يحدَّ من مسؤوليته ينطبقُ في أي دعوى قضائية أو إجراءات تحكيمية تقام، سواء على أساس العقد أم المسؤولية التقصيرية أم غير ذلك، بسبب هلاك البضاعة المشمولة بعقد النقل أو تلفها أو التأخر في تسليمها، أو بسبب الإخلال بأي واجب آخر بمقتضى هذه الاتفاقية، تجاه:

" In connection with the provisions of article 4 of the present Convention, the Government of Chile shall not apply the provisions thereof to incidents that occur in its internal waters and in the waters of Magellan Strait. "
" فيما يتعلق بأحكام المادة ٤ من هذه الاتفاقية، لن تطبق حكومة شيلي أحكام هذه الاتفاقية على الحوادث التي تقع داخل مياهها الداخلية ومياه مضيق ماجيلان " .

[5. No provision of this article can have the effect of calling into question the international responsibility of the State.]
