By failing to accept the competence of the Committee to determine whether a communication shall be registered and by declaring beforehand that it will not accept the determination of the Committee on the admissibility or the merits of that communication, the State party violates its obligations under article 1 of the Optional Protocol to the Covenant.

Sir Nigel RODLEY said he had assumed that if his report was adopted, the Committee would take a decision declaring a State party to be in breach of its obligations under the Covenant, which would be communicated to that State party.

The Committee observes that, by failing to accept the competence of the Committee to determine whether a communication should be registered and by declaring beforehand that it will not accept the Committee's determination on the admissibility or the merits of the communication, the State party is violating its obligations under article 1 of the Optional Protocol to the International Covenant on Civil and Political Rights.

In its Views, finding a violation of articles 6 and 14 of the Covenant, the Committee also held that the State party had breached its obligations under the Optional Protocol in the same terms as formulated in the Piandiong Views (annex X, sect. M, paras. 5.1 and 5.3).

The Committee further notes that by denying the right of an individual to be represented by a lawyer (or a designated person) of his/her choice before the Committee, the State party fails to meet its obligations under the Optional Protocol to the Covenant.

3.13 The petitioners allege that the State party has violated its obligations under articles 4 and 6 of the Convention because, the Copenhagen Police having failed to carry out a proper investigation, the petitioners have been deprived of the opportunity to establish whether their rights under the Convention had been violated.

The Court held the second counterclaim admissible in part and found that, by virtue of the conduct of its armed forces, which attacked the Ugandan embassy in Kinshasa and maltreated diplomats and other persons on the embassy premises, as well as Ugandan diplomats at Ndjili International Airport, the DRC had breached its obligations under Articles 22 and 29 of the Vienna Convention on Diplomatic Relations.
كما قضت المحكمة بأن الطلب المضاد الثاني مقبول جزئيا واستنتجت أنه، بمقتضى تصرف القوات المسلحة لجمهورية الكونغو الديمقراطية التي هاجمت السفارة الأوغندية في كينشاسا وأساءت معاملة الدبلوماسيين والأشخاص الآخرين الموجودين في مبني السفارة، وكذا الدبلوماسيين الأوغنديين في مطار ندجيلي الدولي، أخلت بالتزاماتها بموجب المادتين 22 و 29 من اتفاقية فيينا للعلاقات الدبلوماسية.
