٥ - لا يجوز قبول أدلة يتم الحصول عليها بوسائل تنطوي على مخالفة خطيرة لهذا النظام اﻷساسي أو لقواعد أخرى في القانون الدولي.

As regards the rules of evidence, too, the draft statute provides in article 44 only that " evidence obtained by means of a serious violation of this Statute or of other rules of international law shall not be admissible " , and it does not provide for concrete conditions to make evidence admissible.

(a) No person shall be arrested based on evidence obtained by means of a search that violates international standards.
(أ) لا يوقَف أحد استناداً إلى أدلة يتم الحصول عليها عن طريق تفتيش ينتهك المعايير الدولية.

(b) No person shall be arrested based on evidence obtained under torture, or cruel, inhuman or degrading treatment.
(ب) لا يوقَف أحد بالاستناد إلى أدلة يتم الحصول عليها بالتعذيب أو عن طريق المعاملة القاسية أو اللاإنسانية أو القاسية.

The adoption of the National Action Charter in 2001 which outlines reforms aimed at enhancing non-discrimination, due process of law and the prohibition of torture and arbitrary arrest and stating, inter alia, that any evidence obtained through torture is inadmissible;
