The Guidelines also, with the reference to the discussions in the UNCITRAL Working Group, adopted the approach of treating ERAs as a procurement method in itself, rather than an optional phase in other procurement methods.
كما اعتمدت المبادئ التوجيهية، بالإشارة إلى المناقشات التي جرت إطار فريق الأونسيترال العامل، نهج معاملة المناقصات الإلكترونية باعتبارها أسلوب اشتراء قائما بذاته، وليس مرحلة اختيارية في أساليب اشتراء أخرى.

37. The Working Group considered the structure of the Model Law as a whole, noting that the conditions for use and procedures to be applied in particular procurement methods appeared in different chapters of the Model Law.

57. The current " principal method for procurement of services " under chapter IV of the UNCITRAL Model Law is flexible, in that it incorporates flexible procurement methods, which can involve negotiation, for selecting the winner after submission of suppliers' proposals.

14. Some information required to be provided for other procurement methods is not appropriate in the context of ERAs, and so does not appear in paragraph (1).

Those considerations revolved around the need for a certain degree of flexibility with regard to the wide solicitation rule, so as to provide enough flexibility to take account of the differing circumstances in enacting States, and thus to avoid steering procuring entities away from chapter IV bis to less competitive procurement methods or encouraging the wholesale exclusion of categories of services from the application of the Model Law.

It was observed that there were two systems of ERAs in current use: those that treated ERAs as a procurement method itself, and those that treated ERAs as an optional phase in other procurement methods.
58- ولوحظ أن هناك نظامين من المزادات العكسية الإلكترونية يجري استعمالهما، وهما: النظام الذي يعامل تلك المزادات على أنها أسلوب اشتراء في حد ذاتها، والنظام الذي يعاملها على أنها مرحلة اختيارية في أساليب اشتراء أخرى.

2. With respect to ERAs used as a phase in other procurement methods or technique, the procurement regulations may provide for an option for the procuring entity to stipulate in the solicitation documents that the award the procurement contract may take place on the basis of the initial bids.
2- وفيما يتعلق بالمناقصات الإلكترونية التي تُستخدم كمرحلة في طرائق أو أساليب اشتراء أخرى، يجوز للوائح الاشتراء أن تنص على خيار يتيح للجهة المشترية أن تنص في وثائق الالتماس على إمكانية إرساء عقد الاشتراء استناداً إلى العروض الأولية.

It was noted that the footnote as drafted mentioned the availability of the two principal methods of procurement, mentioned that there were alternative methods of procurement and then informed that States might choose not to enact all those methods into their national legislation.
ولوحظ أن الحاشية في صياغتها الحالية ذكرت إتاحة اﻷسلوبين الرئيسيين للاشتراء وذكرت أن هناك أساليب اشتراء بديلة ثم قالت إن للدول أن تختار ألا تدرج هذه اﻷساليب كلها في تشريعها الوطني.

It was his impression that the Commission did not have the expertise to adequately deal with all the complexities of the Model Law as it related to services and had therefore sought to ensure that all methods of procurement of goods would automatically be available for services.

(c) Owing to a catastrophic event, there is an urgent need for the goods, construction or services, making it impractical to use other methods of procurement because of the time involved in using those methods;

)ز( إذا استخدمت إجراءات اشتراء تنطوي على أساليب اشتراء أخرى غير أسلوب المناقصة، ولم تؤد هذه اﻹجراءات إلى إبرام عقد اشتراء، يدرج في السجل بيان عن ذلك وعن اﻷسباب الداعية إليه؛

(g) if, in procurement proceedings involving methods of procurement other than tendering, those proceedings did not result in a procurement contract, a statement to that effect and of the grounds therefor;

50. The Working Group also agreed that the Model Law should not prevent appropriate use of ERAs as a procurement tool in procurement methods other than tendering, such as request for quotations, as well as in any other procurement techniques that may be envisaged by the revised Model Law, such as framework agreements and dynamic purchasing systems.
50- واتفق الفريق العامل أيضا على أن القانون النموذجي لا ينبغي أن يمنع استخدام المناقصات (المزادات العكسية) الإلكترونية كأداة للاشتراء في أساليب اشتراء غير المناقصة، مثل طلب عروض الأسعار، وكذلك في أي أساليب اشتراء أخرى قد يرتئيها القانون النموذجي المنقح، مثل الاتفاقات الإطارية ونظم الشراء الدينامي.

The organizational conflicts of interest may pose a serious threat to competition in that the third parties will wish to maximize their returns by promoting ERAs, without necessarily considering whether they are the appropriate procurement technique. These issues arise also in other procurement techniques, such as framework agreements, and generally where outsourcing is concerned.
وقد تمثّل حالات تضارب المصالح التنظيمية خطرا شديدا على التنافس، لأنَّ الأطراف الثالثة سترغب في تعظيم عائداتها من خلال الترويج للمناقصات الإلكترونية من دون النظر بالضرورة في ما إذا كانت تمثّل أسلوب الاشتراء المناسب.() وتنشأ أيضا هذه المسائل في أساليب اشتراء أخرى، مثل الاتفاقات الإطارية، وفي الحالات المتعلقة عموما بالاستعانة بمصادر خارجية.
