In conformity with paragraphs 22 to 24 of its revised methods of work, the Working Group, without prejudging whether the detention was arbitrary or not, drew the attention of each of the Governments concerned to the specific case as reported and appealed to it to take the necessary measures to ensure that the detained persons' right to life and to physical integrity was respected.
وقام الفريق العامل، عملاً بالفقرات 22 إلى 24 من أساليب عمله المنقحة ودون الحكم مسبقاً على تعسفية أو عدم تعسفية الاحتجاز، باسترعاء انتباه كل حكومة من الحكومات المعنية إلى الحالة المعينة كما عرضت، وناشدها أن تتخذ التدابير اللازمة لضمان مراعاة حق الشخص المحتجز في الحياة وفي سلامة بدنه.

37. In its resolution 1998/41, the Commission on Human Rights invited the Working Group to ensure the implementation of its revised methods of work, in accordance with the relevant provisions of Commission resolutions 1996/28 and 1997/50.
37- دعت لجنة حقوق الإنسان في قرارها 1998/41 الفريق العامل إلى كفالة تطبيق أساليب عمله المنقحة عملاً بالأحكام ذات الصلة من قراري اللجنة 1996/28 و1997/50.

In its revised methods of work, the Working Group has taken particular account of the provisions of the United Nations Standard Minimum Rules for the Administration of Juvenile Justice (“The Beijing Rules”).
ولقد أولى الفريق العامل اهتماماً خاصاً في أساليب عمله المنقحة للأحكام المنصوص عليها في قواعد الأمم المتحدة النموذجية الدنيا لإدارة شؤون قضاء الأحداث ( " قواعد بكين " ).

7. Since the source did not rebut the statement of the Government, the Working Group, on the basis of paragraph 17 (a) of its revised methods of work, decided to file the case.
7- وإزاء عدم نفي المصدر لبيان الحكومة قرر الفريق العامل على أساس الفقرة 17(أ) من أساليب عمله المنقحة حفظ القضية.

Taking in consideration that Mr. Korepanov has been released and in conformity with paragraph 17 (a) of its revised methods of work, the Working Group decides to file the case.
إذ يحيط الفريق العامل علماً بالإفراج عن السيد كوريبانوف، يقرر حفظ القضية عملاً بالفقرة 17(أ) من أساليب عمله المنقحة.

Despite the absence of a response from the Government, the Working Group considers that it is in the position to render an opinion in accordance with paragraph 16 of its revised methods of work and on the basis of information made available to it.
13- ورغم عدم ورود رد من الحكومة، يرى الفريق العامل أن بإمكانه إبداء رأيه وفقاً للفقرة 16 من أساليب عمله المنقحة واستناداً إلى المعلومات التي أُتيحت له.

13. Despite the absence of information from the Government, the Working Group considers that it is in a position to render an opinion on the detention of Messrs. Al Karoui and Matri, in conformity with paragraph 16 of its revised methods of work.
13- على الرغم من عدم توفر معلومات من الحكومة، يرى الفريق العامل أن بإمكانه إبداء رأيه بشأن احتجاز كل من السيد القروي والسيد مطري، وذلك وفقاً للفقرة 16 من أساليب عمله المنقحة.

19. Despite the absence of information from the Government, the Working Group considers that it is in a position to render an opinion on the detention of the Petitioners, in conformity with paragraph 16 of its revised methods of work.
19- بالرغم من عدم ورود معلومات من الحكومة، يعتبر الفريق العامل أنه بات في وضع يسمح له بإبداء رأي في احتجاز مقدمي الالتماس، وفقاً للفقرة 16 من أساليب عمله المنقحة.

7. Since the above—mentioned persons are said by the Government not to be in detention, and since that affirmation was not challenged by the source, the Working Group considers that it may apply to them the rule set up by paragraph 14.1 (a) of its revised methods of work and file their cases.

4. Having examined the available information and without prejudging the nature of the detention, the Working Group decides to file the cases of Malik Bayramov and Asgar Ahmed in terms of paragraph 14.1 (a) of its revised methods of work.
٤- وبعد النظر في المعلومات المتاحة ودون الحكم مسبقاً على طبيعة الاحتجاز، يقرر الفريق العامل أن يحفظ حالتي السيد مالك بيراموف والسيد أصغار أحمد وفقاً ﻷحكام الفقرة ٤١-١)أ( من أساليب عمله المنقحة.

7. The Working Group, without prejudging the nature of the detention, decides to file the cases of Walter Ledesma and Luis Mellet under the terms of paragraph 14.1 (a) of its revised methods of work.
٧- ويقرر الفريق العامل، بدون الحكم على طبيعة الاحتجاز، حفظ قضيتي والتر ليديسما ولويس ميليه، وفقاً ﻷحكام الفقرة ٤١-١)أ( من أساليب عمله المنقحة.

(a) Having examined the available information and without prejudging the nature of the detention, the Working Group decides to file the case of Abdel Raziq Yassin Farraj in terms of paragraph 14.1 (a) of its revised methods of work.
)أ( يقرر الفريق العامل بعد النظر في المعلومات المتاحة، ودون أن يحكم مسبقاً على طبيعة الاحتجاز، حفظ حالة عبد الرازق ياسين فرّاج وفقاً ﻷحكام الفقرة ٤١-١)أ( من أساليب عمله المنقحة.

4. Having examined the available information and without prejudging the nature of the detention, the Working Group decides to file the case of Ibrahim Sahin in terms of paragraph 14.1 (a) of its revised methods of work.
٤- ويقرر الفريق العامل، بعد النظر في المعلومات المتاحة ودون الحكم مسبقاً على طبيعة الاحتجاز، حفظ قضية ابراهيم شاهين وفقاً ﻷحكام الفقرة ٤١-١)أ( من أساليب عمله المنقحة.

4. Having examined all the available information, and without determining the arbitrary or not arbitrary character of the detention, the Working Group decides to file the case of Abdelkader Tigha, in accordance with paragraph 17 (a) of its revised methods of work.
4- ويقرر الفريق العامل، بعد أن بحث جميع المعلومات المتاحة ودون أن يبت فيما إذا كان الاحتجاز تعسفياً أو لا، حفظ البلاغ عملاً بالفقرة 17(أ) من أساليب عمله المنقحة.

In accordance with article 33 (a) of its revised methods of work, the Working Group considers it appropriate to refer the case to the Special Rapporteurs on torture and other cruel, inhuman or degrading treatment or punishment and on the situation of human rights defenders for appropriate action.
61- ويرى الفريق العامل وفقاً للمادة 33(أ) من أساليب عمله المنقحة أنه من الملائم إحالة القضية إلى المقرر الخاص المعني بمسألة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة والمقررة الخاصة المعنية بحالة المدافعين عن حقوق الإنسان لاتخاذ الإجراءات المناسبة.

In the light of the continued limitations placed on Mr. Sannikov's fundamental rights, including the right to political participation, and the constant threat of re-arrest, it is fitting that the Working Group should consider his case under paragraph 17 (a) of its revised methods of work.
وفي ضوء استمرار القيود المفروضة على الحقوق الأساسية للسيد سنّيكوف، بما في ذلك حقه في المشاركة في الحياة السياسية، وفي ضوء استمرار التهديد بإعادة توقيفه، فإنه من المناسب أن ينظر الفريق العامل في حالة السيد سنّيكوف في إطار الفقرة 17(أ) من أساليب عمله المنقحة.

Taking into consideration that Mr. Korepanov has been released, and in conformity with paragraph 17 (a) of its revised methods of work, the Working Group has decided to file the case.
24- إذ يحيط الفريق العامل علماً بالإفراج عن السيد كوريبانوف، يقرر حفظ القضية عملاً بالفقرة 17(أ) من أساليب عمله المنقحة.

In accordance with paragraph 33 (a) of its revised methods of work (A/HRC/16/47 and Corr. 1, annex), the Working Group considers it appropriate to refer the allegations of torture to the Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment, for appropriate action.
36- وعملاً بالمادة 33(أ) من أساليب عمله المنقحة (A/HRC/16/47 وCorr.1، المرفق)، يرى الفريق العامل أنه من المناسب إبلاغ المقرر الخاص المعني بمسألة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة ادعاءات التعرض للتعذيب لكي يتخذ الإجراءات المناسبة بشأنها.

19. Having considered the communication from the source, and in view of the importance of protecting human rights defenders and the urgency of the matter, the Working Group considers that it is in a position to render an opinion on the case, on the basis of the observations made and pursuant to paragraph 16 of its revised methods of work.
19- بعد النظر في البلاغ الوارد من المصدر وبحكم أهمية حماية المدافعين عن حقوق الإنسان والطابع الملِحِّ الذي تكتسيه هذه المسألة، يرى الفريق العامل أن بإمكانه إصدار رأي بشأن هذه القضية، استناداً إلى الملاحظات التي جرت ووفقاً للفقرة 16 من أساليب عمله المنقحة.

(a) Having examined the available information and without prejudging the nature of the detention, the Working Group decides to file the cases of Tebira Indris Habani, Ali al-Umda Abdel Majid, Fadal Allah Burma, Dr. Abdel Nabi Ali Ahmed, Abdel Mahmoud Abu, Tirab Tendle and Hussein Adam Salama in terms of paragraph 14.1 (a) of its revised methods of work.
