2- فيما يتعلق بالعمال المهاجرين وأفراد أسرهم الذين هم في وضع نظامي، تتعاون الدول الأطراف المعنية، حسب الاقتضاء، بشروط تتفق عليها تلك الدول، بغية العمل على إيجاد أحوال اقتصادية مناسبة لاستقرارهم من جديد وعلي تسهيل إعادة إدماجهم إدماجاً اجتماعياً وثقافياً دائماً في دولة المنشأ.

(c) Measures to impose effective sanctions on persons, groups or entities which use violence, threats or intimidation against migrant workers or members of their families in an irregular situation.
(ج) تدابير لفرض جزاءات فعالة على الأشخاص أو الجماعات أو الكيانات الذين يستخدمون العنف أو التهديد أو التخويف ضد العمال المهاجرين أو أفراد أسرهم الذين هم في وضع غير نظامي.

(c) Consider extending non-contributory social benefits to migrant workers and members of their families in an irregular situation in cases of extreme social vulnerability.

Moreover, migrant workers and members of their families in an irregular situation generally live in fear of being reported to the immigration authorities by public service providers or other officials, or by private individuals, which limits their access to fundamental human rights, as well as their access to justice, and makes them more vulnerable to labour and other types of exploitation and abuse.

When States parties provide for the regularization of migrant workers in their national legislation, they must ensure that all migrant workers and members of their families in an irregular situation have non-discriminatory and effective access to such regularization procedures and that those procedures are not applied in an arbitrary manner (arts. 7 and 69).
