وينبغي للرئيس أن يضمﱢن تقريره اﻷسباب التي ترى اللجنة أنها تدعو الطرفين إلى قبول أسس التسوية المقترحة.

If one of the parties rejects terms of settlement which the other party accepts, it shall inform the latter, in writing, of the reasons why it could not accept them.
فإذا رفض أحد الطرفين أسس التسوية التي يقبلها الطرف اﻵخر، وجب عليه إبلاغه كتابة باﻷسباب التي جعلته غير قادر على قبولها.

Objections were also voiced concerning the requirement that a party which has rejected the terms of settlement should inform the other party of the reasons for the rejection.
وكانت ثمة اعتراضات كذلك على دعوة الطرف الذي يرفض أسس التسوية الى إبلاغ الطرف اﻵخر بأسباب رفضه.

" 3. If the parties accept the terms of settlement proposed by the commission, a document shall be drawn up setting forth the conditions of acceptance.
" ٣ - إذا قبل الطرفان أسس التسوية التي اقترحتها اللجنة، تصاغ وثيقة تبين شروط هذا القبول.

" The terms of settlement proposed shall be simply recommendations submitted to the parties for consideration in order to facilitate an amicable settlement of the dispute.
" تكون أسس التسوية المقترحة، مجرد توصيات مقدمة إلى الطرفين للنظر فيها بغية تيسير التــوصل إلى تسوية ودية للنزاع.

" 3. It is understood that the terms of settlement accepted by the parties are subject to the registration obligation laid down in Article 102 of the Charter of the United Nations.
" ٣ - ويظل مفهوما أنه يجب تسجيل أسس التسوية المقبولة من الطرفين عملا بالمادة ١٠٢ من ميثاق اﻷمم المتحدة.

It was pointed out that the commission should not be required to suggest to the parties terms of settlement which are likely to be accepted by them, as provided in the article.
وقيل إنه لا يجوز مطالبة اللجنة بأن تقترح على الطرفين أسس التسوية التي يحتمل أن تحوز قبولهما، على النحو المنصوص عليه في المادة.

واذا لم يتم التوصل الى تسوية خلال نظر المسألة، تضع اللجنة بالتفصيل في تقرير لرئيسها أسس التسوية التي تراها مناسبة وتقدمها الى الطرفين.

" Article 21 " The terms of settlement proposed shall be merely recommendations submitted to the parties for consideration in order to facilitate an amicable settlement of the dispute.
" تكون أسس التسوية المقترحة، مجرد توصيات مقدمة الى الطرفين للنظر فيها بغية تيسير التوصل الى تسوية ودية للنزاع.

They shall, in particular, refrain from any measures which might have an adverse effect on the terms of settlement proposed by the commission, so long as those terms have not been explicitly rejected by both or one of the parties.
ويمتنع الطرفان، بصفة خاصة، عن اتخاذ أي تدبير قد يكون له أثر ضار على أسس التسوية التي تقترحها اللجنة، طالما لم يرفض الطرفان، أو أحدهما، صراحة تلك اﻷسس.

" 1. On concluding its consideration of the dispute, the commission shall, if full settlement has not been reached, define the terms of settlement which are likely to be acceptable to the parties.
" ١ - إذا لم يتم التوصل إلى تسوية كاملة، يجب على اللجنة عند انتهائها من النظر في النزاع أن تحــدد أسس التسوية التي يحتمل أن تحــوز قبول الطرفــين.

" 2. The parties shall refrain from any measures which might have an adverse effect on the terms of settlement proposed by the commission, until those terms have been explicitly rejected by both or one of the parties and the period established in accordance with article 20, paragraph 2, has expired.
" ٢ - يمتنع الطرفان عــن اتخاذ أي تدبير قـــد يكون له أثر ضار على أسس التسوية التي تقترحها اللجنة، إلى أن يرفض الطرفان أو أحدهما صراحة هذه اﻷسس وتنتهي الفترة الموحدة وفقا للفقرة ٢ من المادة ٢٠.

There was also the view that the last clause at the end of the article referring to the acceptance of the terms of settlement by " both parties " should be deleted.
وكان هناك أيضا رأي يطالب بإلغاء الشرط اﻷخير الوارد في هذه المادة والذي يشير الى قبول أسس التسوية من جانب " الطرفين " .

" 1. On concluding its consideration of the dispute, the commission shall, if full settlement has not been reached, define the terms of settlement which in its opinion are likely to be acceptable to the parties.
" ١ - إذا لم يتم التوصل الى تسوية كاملة، يجب على اللجنة عند انتهائها من النظر في النزاع أن تحدد أسس التسوية التي يحتمل، في رأيها، أن تحوز قبول الطرفين.

" 2. The terms of settlement adopted by the commission shall be set forth in a report communicated by the president of the commission to the agents of the parties, with a request that the agents inform the commission, within a given period, whether the parties accept them.
" ٢ - تكون أسس التسوية المعتمدة من اللجنة متضمنة في تقرير يرسله رئيس اللجنة الى وكيلي الطرفين، طالبا إليهما إخطار اللجنة، خلال فترة زمنية محددة، عما إذا كان الطرفان قد قبلا تلك اﻷسس.

" 3. If the parties accept the terms of settlement proposed by the commission, a procès-verbal shall be drawn up setting forth the conditions of acceptance. The procès-verbal shall be signed by the president and the secretary.
" ٣ - إذا قبل الطرفان أسس التسوية التي اقترحتها اللجنة، تصاغ وثيقة تبين شروط هذا القبول ويوقع الرئيس وأمين اللجنة على تلك الوثيقة.

" 1. If the terms of settlement are not accepted by both parties and the latter do not wish further efforts to be made to reach agreement on different terms, a document signed by the chairman and the secretary of the commission shall be drawn up, omitting the proposed terms and indicating that the parties were unable to accept them and do not wish further efforts to be made to reach agreement on different terms.
" ١ - إذا لم يقبل الطرفان كلاهما أسس التسوية وكانا غير راغبين في مواصلة السعي إلى إيجاد تسوية تقوم على شروط أخـرى، تصـاغ، وثيقـة يوقعهـا كل من رئيس اللجنة وأمينها يذكر فيها، مع إسقاط اﻷسس المقترحة، أن الطرفيـن لا يمكنهمـا قبولهـا ولا يرغبان في مواصلة السعي إلى إيجاد تسوية تقوم على أسس أخرى.
