287. In response to the case of A. Askarov, the delegation informed the Council that A. Askarov had been involved in a local officials' hostage-taking attempt, with the aim of crossing the border.
287- وفيما يتعلق بقضية أ. أسكاروف، أعلن الوفد للمجلس بأن أ. أسكاروف تورط في محاولة لأخذ رهائن من بين مسؤولين حكوميين محليين بغرض عبور الحدود.

Mr. Askarov has alleged that he was beaten severely by police on numerous occasions immediately following his detention and throughout the course of the criminal proceedings against him, and that he was subjected to repeated violations of procedural safeguards such as prompt access to a lawyer and to an effective, independent medical examination.
وادعى السيد أسكاروف أنه تعرض لضرب مبرّح على يد الشرطة مرات عديدة مباشرة بعد احتجازه وطوال مدة الدعوى الجنائية التي رفعت عليه وتعرض لانتهاكات متكررة للضمانات الإجرائية مثل الحصول الفوري على محام والخضوع لفحص طبي فعال ومستقل.

وتلاحظ اللجنة أن الفحوص الطبية الشرعية المستقلة، على ما يبدو، أثبتت ادعاءات التعذيب الذي تعرض له السيد أسكاروف خلال احتجاز الشرطة له وأكدت الإصابات الناجمة عن ذلك ومن جملتها فقدان مستمر للبصر وإصابة دماغية رضّية وإصابة في العمود الفقري.

Information before the Committee suggests that Mr. Askarov's complaints of torture have been raised on numerous occasions with the Prosecutor's office, as well as with the Kyrgyz Ombudsman's office, and with Bazar-Korgon District Court, the Appeal Court and the Supreme Court.

The Committee decided to close the follow-up dialogue concerning the case of Mr. A. Davlatov, and to suspend the dialogue, with a finding of a non-satisfactory implementation of its recommendation, concerning Mr. Karimov, Mr. Askarov, and Mr. N. Davlatov (see A/67/40, chap. VI)
قررت اللجنة إنهاء حوار المتابعة فيما يتعلق بقضية السيد أ. دافلاتوف، ووقف الحوار بعد الانتهاء إلى أن تنفيذ توصيتها فيما يتعلق بالسيد كاريموف، والسيد أسكاروف والسيد ن. دافلاتوف لم يكن مرضياً (انظر A/67/40، المرفق السادس).

As a matter of urgency, the State party should: (a) undertake a full, effective and independent investigation into the claims of torture made by Azimjan Askarov; (b) ensure that Azimjan Askarov receives adequate medical care; and (c) review the grounds for his continued detention in light of his allegations.
